A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, DIRECTING THE CITY
ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS
AND SETTING DEADLINES FOR THE SUBMISSION OF
ARGUMENTS IN CONNECTION WITH THE MARCH 3,
2020 SPECIAL MUNICIPAL ELECTION
WHEREAS, a Special Municipal Election is to be held in the City of West Covina,
California, on March 3, 2020, at which there will be submitted to the voters the following question
Shall the ordinance establishing a three-quarter percent (0.751/o) local YES
sales tax (transactions and use tax) that will raise approximately $9.7
million annually for the City's general fund until ended by voters and
establishing an Oversight Committee, be adopted? NO
WHEREAS, the City Council desires to take certain actions with respect to that election
and that ballot measure.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. The Assistant City Clerk shall accept ballot arguments in favor of and
against the measure in the manner required by law. If more than one argument for or against the
measure is submitted to the Assistant City Clerk, the Assistant City Clerk shall select one of the
arguments in favor and one against the measure for printing and distribution to the voters in
accordance with the order specified in Elections Code section 9287. The arguments may be
changed or withdrawn until and including 5:30 p.m. on December 11, 2019, the date fixed by the
Assistant City Clerk after which no arguments for or against the measure may be submitted to the
Assistant City Clerk.
SECTION 2. The deadline for submitting written arguments to the Assistant City Clerk
is 5:30 p.m. on December 11, 2019. The arguments shall be filed with the Assistant City Clerk,
signed, with the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on
behalf of an organization, the name of the organization, and the printed name and signature of at
least one of its principal officers who is the author of the argument. The arguments shall be
accompanied by the Form of Statement To Be Filed By Author(s) of Argument, attached hereto
as Exhibit A.
SECTION 3. Pursuant to Elections Code section 9280, the City Council directs the
Assistant City Clerk to transmit a copy of the proposed measure to the City Attorney. The City
Attorney shall prepare an impartial analysis of the measure, not to exceed 500 words in length,
showing the effect of the measure on the existing law and the operation of the measure, and
transmit such impartial analysis to the Assistant City Clerk by 5:30 p.m. on December 11, 2019.
SECTION 4. Pursuant to Elections Code section 9285, the City Council authorizes the
submission of rebuttal arguments. The deadline for submitting rebuttal arguments is 5:30 p.m, on
December 19, 2019.
SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution
and enter it into the book of original resolutions.
