Resolution - 2017-99RESOLUTION NO. 2017-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA CERTIFYING THE MITIGATED NEGATIVE DECLARATION ENVIRONMENTAL DOCUMENT FOR THE GLENDORA AVENUE REVITALIZATION PROJECT MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: City of West Covina LOCATION: Glendora Avenue (between West Covina Parkway and Garvey Avenue South) WHEREAS, the City has prepared a final roadway concept to redesign a portion of Glendora Avenue between West Covina Parkway and Garvey Avenue South; and WHEREAS, the proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act (CEQA); and WHEREAS, an initial study was prepared for said project; and WHEREAS, based upon the findings of the initial study, it was determined that the proposed project will not have a significant impact on the environment and will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the California Fish and Game Code; and WHEREAS, a Mitigated Negative Declaration of Environmental Impact was prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended, and mitigation measures are included in said Negative Declaration in support of the finding that there will not be a significant effect on the environment as a result of this project. NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: 1. After receiving and considering all determinations, studies, documents, and recommendations, as well as other appropriate public comments, the City Council of the City of West Covina hereby certifies the Mitigated Negative Declaration of Environmental Impact, subject to compliance with the mitigation measures that are recommended in the Mitigated Negative Declaration of Environmental Impact as set forth in Exhibit A. ATTEST: 2. Non-compliance with the aforementioned mitigation measures as by the monitoring department/agency and any measures taken to correct said non-compliance shall be immediately reported to the Planning Department on the City of West Covina Monitoring Checklist Form. 3. The City agrees to implement the aforementioned mitigation measures and monitoring or reporting requirements. 4. Failure of any contractors to comply with any aforementioned mitigation measures and/or monitoring or reporting requirements will result in a written notice of violation from the City to the contractor at which time the City may order that all or a portion of pre- construction, construction, post-construction activity or project implementation must cease until Compliance is reached. Implement the following mitigation measures during Project construction for dust emissions control: • Apply soil stabilizers or moisten inactive areas. • Prepare a high wind dust control plan. • Address previously disturbed areas if subsequent construction is delayed. • Water exposed surfaces as needed to avoid visible dust leaving the construction site (typically 2 to 3 times per day). • Cover all stock piles with tarps at the end of each day or as needed. • Provide water spray during loading and unloading of earthen materials. • Minimize in/out traffic from construction zone. • Cover all trucks hauling dirt, sand, or loose material and require all trucks to maintain at least 2 feet of freeboard. • Sweep streets daily if visible soil material is carried out from the construction site. Condition of Approval Review Lighting Plan Prior to Issuance of Building Permit Public Works Dept. MM-AQ-2 Exhaust Emissions Control. Implement the following mitigation measures during Project construction for exhaust emissions control: • Utilize well-tuned off-road construction equipment. • Establish a preference for contractors using Tier 3 or better heavy equipment. • Enforce 5-minute idling limits for both on-road trucks and off-road equipment. During the Project the applicant shall ensure that grading and street improvement plans include the following measures and that the measures shall be followed by the construction contractor and crew: a) the storage of hazardous materials, chemicals, fuels, and oils and fueling of construction equipment shall be a minimum of 45 meters (150 feet) from any drainage, water supply, or other water features; b) hazardous materials stored on-site shall be stored in a neat, orderly manner in appropriate containers and, if possible, under a roof or other enclosure; c) whenever possible, all of a product shall be used up before disposal of its container; d) if surplus product must be disposed of, the manufacturer's or the local and state recommended methods for disposal shall be followed; e) spills shall be contained and cleaned up immediately after discovery. Manufacturer's methods for spill cleanup of a material shall be followed as described on the Material Safety Data Sheets (MSDS) for each product. Hydrology and Water Quality MM-HYD-1 Prior to construction activities, a Storm Water Pollution Prevention Plan (SWPPP) and Water Quality Management Plan (WQMP) will be prepared to the requirements of the City of West Covina Municipal Code and State Regional Water Quality Control Board's Basin Plan. Condition of Approval = Plan Check 84 Site inspection During & after project construction. Public Works Dept. Noise MM-N-1 Construction is only permitted to take place between the hours of 7:00 a.m. and 8:00 p.m. on Monday through Saturday. All construction equipment shall use properly operating mufflers.
