A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA
AMENDING RESOLUTION NO. 8369, AUTHORIZING THE CITY MANAGER
OR ACTING CITY MANAGER TO APPROVE GENERAL LIABILITY AND
WORKERS' COMPENSATION CLAIM SETTLEMENTS IN THE AMOUNT OF
THIRTY THOUSAND DOLLARS ($30,000) OR LESS
WHEREAS, the California Tort Claims Act (Government Code Sections 900 et seq.)
establishes a procedure for the filing of claims against the City for injury or
damage alleged to be due to the negligence of a City employee or the danger
or defective condition of City property, and
WHEREAS, Government Code Section 912.4 requires a public entity to act upon such a
claim with 45 days after it is presented to it, and
WHEREAS, in those cases where the amount claimed is $30,000 or less, the public
interest is served by the prompt investigation of the merits of the claim, and
WHEREAS, the City Manager has established a procedure for the investigation of such
claims, and:
WHEREAS, Government Code Section 935.4 permits a City, by resolution to authorize an
employee of the City to allow, compromise or settle certain claims against
the City:
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST COVINA AS FOLLOWS:
SECTION 1. The City Council of the City of West Covina does hereby delegate to the
City Manager or Acting City Manager of the City of West Covina, the authority to allow,
compromise or settle claims filed against the City of West Covina in which injury, damage
or loss claimed, or workers' compensation claims in the amount of thirty thousand dollars
($30,000) or less.
SECTION 2. The City Clerk shall certify to the adoption of this resolution and
thereafter the same shall be in full force and effect.
