Resolution - 2016-35RESOLUTION NO. 2016-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE MEMORANDA OF IJNDERSTANDtNG BETWEEN THE CITY OF WEST COVINA AND THE GENERAL EMPLOYEES' ASSOCIATION, THE CONFIDENTIAL EMPLOYEES' ASSOCIATION, THE MAINTENANCE AND CRAFTS EMPLOYEES' ASSOCIATION AND THE MID -MANAGEMENT EMPLOYEES' ASSOCIATION FOR THE PERIOD OF JULY 1, 2015 THROUGH JUNE 30,2016 The City Council of the City of West Covina does resolve as follows: WHEREAS, the City of West Covina has met and conferred with representatives for the General Employees' Association, the Confidential Employees' Association, the Maintenance and Crafts Employees' Association and the Mid -Management Employees' Association; and, WHEREAS, the City of West Covina and the General Employees' Association, the Confidential Employees' Association, the Maintenance and Crafts Employees' Association and the Mid - Management Employees' Association have agreed upon certain changes to the benefits and terms and conditions of employment in the agreed upon Memoranda of Understanding for tile period of July 1, 2015 through June 30, 2016. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST COVINA AS FOLLOWS: SECTION 1. The one (1) year agreement from July 1� 2015 through June 30, 2016, between the City of West Covina and the General Employees' Association, the Confidential Employees' Association, the Maintenance and Crafts Employees' Association and the Mid -Management Employees' Association are hereby approved and ratified and all applicable changes are contained in the Amendments to the Memoranda of Understanding (Exhibit 1) are hereby adopted. . SECTION 2. That this resolution shall become effective immediately upon passage and adoption. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. In addition, the parties agree that the West Covina General Employees' Association Memorandum of Understanding shall be amended as follows. ARTICLE TWO — SALARIES AND COMPENSATION SALARY SCHEDULE Effective July 1, 2015, the base salary for the General Employees' Association members shall increase two percent (2%). To be eligible for a retroactive salary adjustment members of the General Employees' Association must be employed by the City of West Covina on Apri 1 19, 2016. In the event the City and another represented bargaining group agree to salary adjustments greater than the two percent (2%) for the period of July 1, 2015 through June 30, 2016, the City and the General Employees' Association agree to reopen salary negotiations. However, in no case shall the salary adjustment be lower than 2%. ARTICLE FIVE — LEAVE POLICIES II. VACATION B. Payment of Unused Vacation Leave Time Upon the employee's request he/she may be paid the straight time equivalent of his/her salary in lieu of vacation time off. Such payment shall be for no more than forty (40) hours in any calendar year. Ill. SICK LEAVE E. Sick Leave Payoff Upon Retirement Unit employees, who retire from the City other than by discharge, shall be paid at the employee's hourly rate of pay for one-half (1/2) of all sick leave accrued to the time of such employee's retirement to maximum of three hundred and sixty (360) hours. However, fifty percent (50%) of those hours eligible for cash out (maximum 180 hours) must be put into the employee's RHS account. All other terms and conditions of the Memorandum of Understanding between the City of West Covina and the General Employee's Association shall remain in full force and effect. In addition, the parties agree that the West Covina Confidential Employees' Association Memorandum of Understanding shall be amended as follows. ARTICLE TWO — SALARIES AND COMPENSATION SALARYSCHEDULE Effective July 1, 2015, the base salary for the Confidential Employees' Association members shall increase two percent (2%). To be eligible for a retroactive salary adjustment members of the Confidential Employees' Association must be employed by the City of West Covina on April t9, 2016, fn the event the City and another represented bargaining group agree to salary adjustments greater than the two percent (2%) for the period of July 1, 2015 through June 30, 2016, the City and the Confidential Employees' Association agree to reopen salary negotiations. However, in no case shall the salary adjustment be lower than,2%. ARTICLE FIVE — LEAVE POLICIES IN. SICK LEAVE E. Sick Leave Payoff Upon Retirement Unit employees, who retire from the City other than by discharge, shall be paid at the employee's hourly rate of pay for one-half (1/2) of all sick leave accrued to the time of such employee's retirement to maximum of four hundred and forty (440) hours. However, fifty percent (50%) of those hours eligible for cash out (maximum 220 hours) must be put into the employee's RHS account. OTHER ONE TIME LEAVE CASH OUT Confidential employees are eligible for a one-time additional cash out tip to ten (10) hours of vacation and/or sick leave. All other terms and conditions of the Memorandum of Understanding between the City of West Covina and the Confidential Employee's Association shall remain in full force and effect. XII. SAFETY BOOT ALLOWANCE The City shall establish a voucher program with a mutually acceptable local safety boot provider. Unit employees shall be eligible to redeem up to $400 per calendar year (January I — December 3 1) for purchase of safety boots. The Vendor agreed upon by the parties shall by Red Wing. The Vendor may only be chan2ed bv mutually agreement of the oarties. For Calendar Year 2016. uie employees shall receive a voucher of $200 (which is the S400 annual voucher mmus the S200 stipend alreadv received this fiscal vear. All other terms and conditions of the Memorandum of Understanding between the City of West Covina and the Maintenance and Crafts Employee's Association shall remain in full force and effect. However, in no case shafl the salary adjustment be lower than two percent (2%). ARTICLE FIVE — LEAVE POLICIES Ill. ADMINISTRATIVE LEAVE — MID MANAGMENT D. Administrative Leave Policy Employees may submit a request to the City Manager to carry over a maximum of forty (40) hours of unused Administrative Leave to the next calendar year; which must be used within six (6) months. Approval of requests are the sole discretion of the City Manager. OTHER ONE TIME LEAVE CASH OUT Mid-lvlana.�ement employees are eligible for a one-time additional cash out up to ten (10) hours of vacation and/or sick leave. SALARY SURVEY In the July 1, 2014 through June 30, 2015 amendment to the Mid-Mana.gement memorandum of understanding, the City agreed to conduct a salary survey as part of the Fiscal Year 2014-2015 budget discussions; however, the survey was not completed. The City agrees to conduct a salary survey of those positions identified in the Mid -Management Employee Association for the upcoming Fiscal Year 2016-2017 budget discussion. Conducting the salary survey does not commit the City to implementing any increases or decreases in salary, benefits, or other items at that time. All other terms and conditions of the Memorandum of Understanding between the City of West Covina and the Mid -Management Employee's Association shall remain in full force and effect.
