A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, AUTHORIZING AND DIRECTING THE HUMAN
RESOURCES COMMISSION OF THE CITY OF WEST COVINA TO
DETERMINE THE DISABILITY FOR RETIREMENT PURPOSES OF
LOCAL SAFETY MEMBERS AND REPEALING RESOLUTION NO. 4870
PURSUANT TO SECTION 21154 AND 21157 OF THE CALIFORNIA
GOVERNMENT CODE.
WHEREAS, the City of West Covina (hereafter referred to as "Agency") is a
contracting agency of the Public Employees' Retirement System (hereafter referred to as
"CalPERS"), and
WHEREAS, CalPERS requires that a contracting agency determine whether an
employee of such agency in employment in which he is classified as a local safety member is
disabled for purposes of the Public Employees' Retirement Law and whether such disability is
"industrial" within the meaning of such law.. and
WHEREAS, the City Council of the City of West Covina has determined upon legal
advice that it may delegate authority to make such determination to the Human Resources
Commission of the City of West Covina;
NOW, THEREFORE, the City Council of the City of West Covina does resolve as
follows:
SECTION 1. That Resolution No. 4870 is hereby repealed and replaced in its entirety
by this Resolution.
SECTION 2. That the City Council of the City of West Covina does hereby delegate
to the Human Resources Commission of the City of West Covina the authority to make
determination under Sections 21154 and 21157 of the Goverriment Code, of disability and
whether such disability is industrial and to certify such determinations and all other necessary
information to CalPERS on behalf of the Agency.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
