A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, SUSPENDING
COLLECTION OF THE CITY'S BUSINESS LICENSE
TAX ON AUTHORIZED DRIVERS OF
TRANSPORTATION NETWORK CARRIERS
REGISTERED WITH THE CALIFORNIA PUBLIC
UTILITIES COMMISSION
WHEREAS, the City Council of the City of West Covina, has established a
comprehensive business license tax program which is partly regulatory in nature and partly for
revenue purposes, and which is codified in Chapter 14 of its Municipal Code;
WHEREAS, the City's business license tax applies to all non-exempt businesses doing
business anywhere within the City; and
WHEREAS, the City's Municipal Code authorizes the City Council to suspend
imposition of business license taxes imposed on certain categories of business for a period of
time deemed to be equitable; and
WHEREAS, the City Council wishes to temporarily suspend collection of business
license taxes on authorized drivers for Transportation Network Companies (TNC's), as that term
is defined by the California Public Utilities Commission.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That lawfully authorized drivers for Transportation Network Companies
who are properly registered with the California Public Utilities Commission shall be exempt
from application of the City of West Covina's business license tax, codified in Chapter 14 of the
City of West Covina Municipal Code until the City Council determines otherwise by subsequent
resolution.
SECTION 2. Be it further resolved that any other resolutions in parts of any other
resolution in conflict herewith are hereby repealed.
SECTION 3. Should any section, subsection, clause or provision of this Resolution for
any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall
not affect the validity or Constitutionality of the remaining portions of this Resolution, it being
hereby expressly declared that this Resolution, and each and every section, subsection, sentence,
clause and phrase hereof would have been prepared, proposed, approved, adopted and/or ratified
irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases of
this Resolution be declared invalid or unconstitutional.
SECTION 4. The City Clerk shall certify to the passage and adoption of this Resolution.
