A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, ADOPTING RETAINER AGREEMENT FOR
LEGAL SERVICES WITH JONES & MAYER
WHEREAS, at a duly noticed Special Meetingof the West Covina City Council on
August 18, 2014, the City Council voted to approve a certain "Retainer Agreement for City
Attorney Services," with the law firm of Jones & Mayer for City Attorney to provide services as
City Attorney and Successor Agency Counsel; and
WHEREAS, an alleged violation of the Ralph M. Brown Act (Gov. Code §54950 et seq.)
arising out of the City Council's adoption of the "Retainer Agreement for City Attorney
Services" at the August 18, 2014 Special Meeting has resulted in the filing of a civil action in the
Superior Court of California, County of Los Angeles entitled The Inland Oversight Committee,
and DOES 1 through 10 v. City of West Covina, et al., Case No. BS152091 on October 21, 2014;
and
WHEREAS, the City of West Covina desires to retain Jones & Mayer, including
Kimberly Hall Barlow and Ivy Tsai to perform its City Attorney and Successor Agency Counsel
Services; and
WHEREAS,the City Council denies that there was any violation of the Ralph M. Brown
Act (Gov. Code §54950et seq.) by adoption of the "Retainer Agreement for City Attorney
Services" at the August 18, 2014 Special Meeting; and
WHEREAS, notwithstanding the foregoing, the City Council seeks to cure and correct
any alleged violation of Ralph M. Brown Act (Gov. Code §54950 et seq.) arising out of its
adoption of the "Retainer Agreement for City Attorney Services" at the August 18, 2014 Special
Meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of West
Covina, California, as follows:
SECTION 1.Recitals. The recitals stated above are true and correct.
SECTION 2.Adoption of Retainer Agreement for Legal Services. The City Council
hereby does the following: (1) reaffirms the action taken on August 18, 2014, and (2) hereby
approves the "Retainer Agreement for Legal Services" with Jones & Mayer for City Attorney
and Successor Agency Legal Services to be provided by Kimberly Hall Barlow and Ivy Tsai and
does authorize and direct the Mayor to execute the Agreement on behalf of City of West Covina.
SECTION 3.Effective Date. This Resolution shall become effective immediately upon
its adoption.
