Resolution - 2014-29RESOLUTION NO.2014-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 13-04 AND EAST HILLS MASTER PLAN AMENDMENT NO. 13 GENERAL PLAN AMENDMENT NO. 13-04 EAST HILLS MASTER PLAN AMENDMENT NO. 13 MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: Brandywine Homes and the Irvine Asset Group (Brett Whitehead) LOCATION: 3228, 3238 and 3244 Holt Avenue WHEREAS, there was filed with this Commission a verified application on the forms prescribed in Chapter 26, Article VI of the West Covina Municipal Code, requesting the redesignation of land use as set forth in the General Plan and East Hills Master Plan from: "Residential Suburban" to "Medium Residential" on that certain property generally described as: Assessor's Parcel Number 8480-002-051, 8400-002-052 and 8400-002-053, in the records of the Los Angeles County Assessor; and WHEREAS, consistent with this request, the applicant has also requested a zone change (ZC 13-04) from "Residential Agriculture" to "Specific Plan;" and WHEREAS, consistent with this request, a precise plan (PP 13-07) for the site plan and architecture has been submitted for the development of the project; and WHEREAS, consistent with this request, the applicant has also requested a tentative tract map (TTM 72579) for the subdivision of the "Project Site" to consolidate three (3) contiguous parcels and to create residential condominium units for the development of 48 town -home units and a tree removal permit JR No. 13-09) to remove significant trees; and WHEREAS, it is a stated goal of the Housing Element of the General Plan to "Provide a variety of housing types to accommodate all economic segments of the City;" and WHEREAS, it is a stated goal of the Housing Element of the General Plan to "Minimize the impact of governmental constraints on housing production and affordability," and WHEREAS, it is a stated goal of the Housing Element of the General Plan to "Promote equal housing opportunity for all residents," and WHEREAS, it is a stated goal of the Housing Element of the General Plan to "Identify adequate sites to achieve housing variety," and WHEREAS, it is a stated policy of the Housing Element of the General Plan to "Provide high quality of high quality housing for current and future residents at all income levels to achieve a "balanced" community," and WHEREAS, it is a stated policy of the Housing Element of the General Plan to "Support innovative public, private and non-profit efforts toward the development of affordable housing," and WHEREAS, it is a stated policy of the Housing Element of the General Plan to "Encourage housing construction or alteration to meet the needs of residents with special needs such as large families, the elderly and disabled," and WHEREAS, it is a stated policy of the Housing Element of the General Plan to "Provide a range of residential development types in West Covina, including low density single-family Resolution No: 2014-29 Page 2 homes, moderate density townhomes, higher density multi -family units, and residential/commercial mixed use in order to address the City's share of regional housing needs." WHEREAS, it is a stated policy of the Land Use Element of the General Plan, "The City should continue to assure that residential development conforms to the policies and actions specified in its Housing Element." WHEREAS, the Planning Commission upon giving the required notice did on the 13th day of May, 2014, conduct a duly advertised public hearing as prescribed by law to consider said application; and WHEREAS, in order to allow the.applicant additional time to address the concerns raised by the residents in the vicinity of the project, at its regular meeting held on the 131h day of May, 2014 the Planning Commission voted to continue the public hearing to their regularly scheduled meeting for May 27, 2014, and WHEREAS, the Planning Commission upon continuation of the public hearing did on the 27'' day of May, 2014, conduct a duly advertised public hearing as prescribed by law to consider said application for General Plan Amendment and Revision to the East Hills Master plan, at which time the Planning Commission adopted Resolution No. 14-5613 recommending approval to the City Council; and WHEREAS, the City Council did, on the 17th day of June, 2014, conduct a duly advertised public hearing as prescribed by law, and considered evidence presented by the Planning Commission, Planning Department, and other interested parties. NOW; THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION 1: Based on the evidence presented, both oral and documentary, the City Council approve General Plan Amendment No. 13-04, amending the land use designation for the subject properties as set forth on the Land Use Map as depicted on A; and SECTION 2: A Mitigated Negative Declaration of Environmental Impact has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. SECTION 3: The City Clerk shall be instructed to the passage and adoption of this Resolution and enter it into the book of original resolution and it shall become effective immediately upon its approval.
