A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, UPHOLDING THE DECISION OF THE
PLANNING COMMISSION AND DENYING SUBCOMMITTEE FOR
DESIGN REVIEW NO. 12-03

CATEGORICAL EXEMPTION
APPLICANT: Leonard Radomskiy
LOCATION: Adjacent to Summerplace Village condominium complex, at the end of
Dryden Lane on the east side of the street
(Assessor's Identification Number 8743-002-036)
WHEREAS, there was filed with the Planning Department a verified application on
forms prescribed by the Commission, a request for. approval to construct a new 1,487-square foot
one-story single-family residence (including a 400-square foot attached two -car garage) on a
7,000-square foot parcel located within the Summerplace Village condominium complex that is
currently developed as open space, on that certain property generally described as:
Assessor's Parcel No. 8743-002-036, as listed in the records of the office of the
Los Angeles County Assessor; and
WHEREAS, the Planning Commission Subcommittee for Design Review (Subcommittee)
did on the 22nd day of January, 2013, review the applicant's request to construct a new single-family
residence and determine to forward the proposal to the Planning Commission for review; and
WHEREAS, the Planning Commission did on the 121h day of February, 2013, conduct a
hearing as, prescribed by law to consider said application; and
WHEREAS, the Planning Commission did adopt Resolution No. 13-5502 denying the
application; and
WHEREAS, on February 13, 2013, an appeal of the Planning Commission action was filed by
Leonard Radomskiy; and
WHEREAS, the City Council did on the 19th day of March, 2013, the 16th day of April,
2013 and the 18th day of June, 2013, continue the .hearing; and
WHEREAS, the City Council did on the 16th day of July, 2013, conduct a public hearing as
prescribed by law to consider said application and considered evidence presented by the Planning
Commission, Planning Department and other interested parties.
WHEREAS, studies and investigations made by this Council and in its behalf reveal the
following facts:
1. The applicant is requesting approval to construct a new 1,487-square foot one-story
single-family residence (including a 400-square foot- attached two -car garage) on a
7,000-square foot parcel located within the Summerplace Village condominium
complex that is currently developed as open space. The open space use has continued
for several decades.
2. The subject property is adjacent to multi -family condominiums which are two story,
attached dwellings of a differing architectural nature than the proposed residential
structure.
3. Pursuant to Section 26-418 of the West Covina Municipal Code, findings necessary
for approval to construct a new single-family residence are as follows:

a. New development, or alterations of existing development should utilize building
materials, color schemes, roof style, and architecture that is visually harmonious
with the subject property and surrounding neighborhood.
b. Vertical and horizontal articulation of building facades should be used -to avoid
long, uninterrupted exterior walls on residences. All structures should have
relief to create an interesting blend and enhance the architecture.
c.. Roof lines should be reasonably compatible with the design and scale of
surrounding structures. Vertical and horizontal roof articulation is encouraged
to avoid long, monotonous, flat sections of roof.
d. The scale and mass of the building should relate to surrounding structures. The
height and bulk of the building should be in scale with buildings on surrounding
sites and should not visually dominate their sites or' call undue attention to
themselves.
e. The buildings should include a variety of materials and colors. Materials shall
be consistently applied and should be chosen to be harmonious with
surrounding structures. Piecemeal embellishments and inconsistent materials
and architecture should be avoided.
4. This project is categorically exempt under the California Environmental Quality Act'
(CEQA) of 1970, Section 15303, Class 3 (New Construction or Conversion of Small
Structures), since the project consists of one single-family residence in a residential
zone.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of West Covina
as follows:
1. On the basis of ' evidence presented, both oral and documentary, the City Council
makes the following findings for denial for the construction of anew 1,487-square
foot one-story single-family residence (including a 400-square foot attached two -car
garage) on a 7,000-square foot parcel located. within the Summerplace Village
condominium complex that is currently developed as open space:
a. The applicant is proposing to construct a new single-family residence on a
parcel located within the Summerplace Village condominium complex that is
currently developed as open space.
The condominium complex is comprised of 23 multi -tenant buildings, while the
proposed single-family residence is a freestanding structure.
The proposed house has a stucco exterior with architectural details above the
garage door and window on the front elevation', while the neighboring
condominium units have stucco exterior with square/rectangular details and
wood siding features.
The proposed house has a traditional gable roof, while the neighboring condo
units have parapet walls separating each unit's roof.
The proposed house includes a garage door on the front elevation, while the
neighboring condo units on S. Dryden Lane have no garage. doors facing the
street (all garages for the condo units are on alleys off of S. Dryden Lane).

The introduction of.a single-family residence will not be visually harmonious
with the surrounding neighborhood.
The subject property was subdivided with the intent to be. an open space lot for
the condominiums, consistent with a neighboring property that was included in
the same subdivision aInd now serves as an open space lot for the
condominiums. The subject property has been used as open space by the condo.

complex . since around the time the .units were occupied. Four of the adjacent
condo units have frontage. on to the open space provided by the subject
property.
d. The scale' of the proposed single-family residence does not relate to the
surrounding structures, as the adjacent residences consist of condominium units.
The proposed house is a single-family unit, while the closest .neighboring units
are in buildings_ with four units, the front as a.one-story and the three rear units
as two -stories. The proposed house is a one-story structure and 67 feet in depth,
while the neighboring four -unit condominium building (three two-story units
and one' one-story unit) is 90 feet in depth. The proposed single-family
residence will look out of place within the condominium complex and will call
undue attention to' itself.
2. The City Council denies the Appeal filed by Leonard Radomskiy. The City Council
upholds the decision of the Planning Commission denying Subcommittee for Design
Review No. 12-03.
