Resolution - 2013-10RESOLUTION NO.2013-10 A RESOLUTION. OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, `CALIFORNIA, IDENTIFYING THE TERMS AND CONDITIONS OF EMPLOYMENT FOR LIMITED SERVICES EMPLOYEES The City Council of the City of West Covina does resolve as follows: WHEREAS, the City has determined that it is in the best interest of employees in Limited Service positions to have clearly defined terms and conditions identified. NOW, THEREFORE, the City Council of the City of West Covina does resolve, determine and order as follows: SECTION L The attached description of terms and conditions of employment for limited service employees shall be formally adopted. SECTION 2. Section 1 of this Resolution shall be effective upon adoption by the City Council of the City of West Covina. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. Limited Service employees receive pay only for actual hours worked. Limited Service classifications may include any full-time classification that exists for the City. Limited Service classifications also include classifications only designated as Limited Service classifications as well as part-time, seasonal and temporary employees. Classifications filled by retired annuitants are also considered to be limited service classifications. Salary: Limited Service classifications that are also used, for full-time positions will receive salary increases based on salary increases received for the full-time equivalent classification. Limited Service classifications only used for Limited Service positions will receive salary increases only when specifically authorized by the City Council. The Limited Service Salary Schedule is provided in Appendix A. Overtime: Limited service employees are to be paid overtime at time and one-half if required to work over forty (40) hours in a work week. Salary Increases: Salary increases for hourly employees shall only be granted after completion of each 1,456 hours of service: Any recommendation for a salary increase must be accompanied by a completed performance evaluation recommending the salary increase based on merit. At -Will: Limited service employees are considered to be at -will employees. As such a limited service employee may be terminated at any time without prior notice and has no appeal rights. Limited service employment shall not be counted towards service time for purposes of establishing seniority or benefits with the City. Maximum Hours Per Fiscal Year: Limited service employees shall only work up to a maximum of one thousand four hundred fifty-six (1,456) hours per fiscal year. This equates to an average of twenty-eight (28) hours per week each fiscal year. Leave: Limited Service employees do not accrue vacation, sick leave, or any other type of leave, or employee benefits unless specifically defined herein. Retirement Savings: Limited service employees shall participate in the City's Retirement Savings Plan. Each employee is required to contribute 7.5% of earnings each pay period into their individual Retirement Savings Account. Deferred Compensation: Limited Service Employees may participate in the City's deferred compensation program. The City does not provide any contribution to deferred compensation for Limited Service Employees. Work -Related Disability Leave: Should a limited service employee become disabled, whether temporarily or permanently, by injury or illness arising out of and in the course of their duties, they shall be entitled to leave of absence while so disabled. Military Leave: Military leave shall be granted in accordance with Section 395 of the State Military and Veteran's Code. Family Care Leave: Leave requested for personal or family illness shall be granted in accordance with the Family Care Leave Act and the California Family Rights Act. Benefits: Employees serving in Limited Service classifications do not accrue vacation, sick leave, compensatory time off and are not paid for City -recognized holidays.
