Resolution - 2012-89RESOLUTION NO.2012-89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ADOPTING A NEW MOU FOR THE GENERAL EMPLOYEES' ASSOCIATION AND AMENDING SALARY AND BENEFITS FOR CLASSES REPRESENTED -BY THE GENERAL EMPLOYEES' ASSOCIATION WHEREAS, the City of West Covina has met and conferred with representatives for the General Employees' Association (GEA). WHEREAS, the City and the GEA have agreed upon certain changes to salary, benefits, and terms and conditions of employment in an agreed upon Memorandum of Understanding (MOU), as outlined in Attachment A; and WHEREAS, this MOU has been referred to the City Council. NOW, THEREFORE, the City Council of the City of West Covina does resolve, determine and order as follows: SECTION 1. Term: MOU is for a two (2) year term, and shall remain in full force and effect through midnight, June 30, 2014. SECTION 2. Salary: The salary ranges for all unit employees be increased by two percent (2%) effective July 1, 2013. SECTION 3. Holiday Closure: City Hall will be closed from December 24th through January I" for Fiscal Years 2012-2013 and 2013-2014. Employees will remain on paid status during this period. SECTION 4. Ongoing Holiday Closure: Effective June 30, 2014, and ongoing, City Hall will be closed from December 24"' through January 1st. Employees will remain on paid status during this period. The day after Thanksgiving will no longer be recognized as City holiday. SECTION 5. Medical Insurance: Effective January 1, 2013, the employee medical insurance will be a cafeteria plan with a maximum City contribution of thirteen hundred six dollars and twenty-four cents ($1306.24) per month. New employees not participating in the City's medical insurance plan will receive three hundred dollars ($300) per month. SECTION 6. PARS EPMC Plan: This supplemental retiree benefit plan will be eliminated effective July 1, 2013, and replaced with the current Retiree Health Savings Plan. Active employees that participated in the PARS EMC Plan will receive three hundred dollars ($300) each July for a period of six (6) years. The City will contribute an additional three hundred dollars ($300) annually into the employee's individual RHS account. SECTION 7. Sick Leave Annual Pay Out: The maximum cash out allowed per year will be increased from forty (40) to sixty (60) hours. All unused sick leave hours above seventy- six (76) to be paid out will be paid .to the employee's RHS account. All unused sick leave hours to be paid out between thirty-six (36) and seventy-six (76) will be paid in cash. SECTION 8. Sick Leave Pay Out at Termination: This would be changed to sick leave pay out at retirement only. Eligible employees will be paid for one-half of unused sick leave hours to a maximum of three hundred twenty (320) hours with fifty percent (50%) contributed to the RHS. SECTION 9. Floating Holiday: Floating Holiday hours will be reduced from forty (40) to thirty (30) hours per year. SECTION 10. Tuition Reimbursement: Effective January 1, 2013, the maximum reimbursement will be increased to $1,500 per year. Resolution No. 2012-89 Page 2 SECTION 11. Retiree Dental: Retirees will be able to enroll in a City retiree dental program with no City contribution. SECTION 12. Vacation: MOU language will be amended with regard to how holiday time is charged. . SECTION 13. Policy and Rule Updates: Changes to various City policies and rules will be negotiated during the term of the MOU. The City Clerk shall certify to the adoption of this Resolution. Term of Agreement— One year Agreement commencing July 1, 2011 through June 30, 2012 2. Salary Increase: The City proposes no salary increase during the term of this agreement. The following adjustments to salaries are proposed in the 2010- 2011 fiscal year. Salary ranges will remain at current levels 3.6% salary reduction for 2010-2011 will terminate July 9, 2011 • Merit increases shall continue as scheduled for eligible employees 3. Benefits: City will maintain same level of health benefits and other benefits during the term of this MOU except as noted elsewhere in this MOU. 4, Retiree Health Savings Plan: • Effective July 1, 2011 City will resume contribution of $75 per month to the RJSP. S. Holiday Closing Unit employees will be granted 30 hours of paid holiday leave to cover a holiday closing between December 26th Ih — 30 . The 30 hours of paid leave is in addition to all other paid leave. Unit employees required to work during the holiday closing shall be allowed to use any hours not taken before the end of the fiscal year. ( 6. Retirement Benefits: PERS City wants employees to pay the entire PERS employee contribution of 8%. The City will continue to pay the PERS Employer contribution for each employee. RESPONSE: Would agree to pay 8% effective January 1, 2012 and ending June 30, 2012 If the City approves, adopts. or extends a memorandum of understanding/side letter with any bargaining unit or group of the City that does not include a requirement that each employee pay its full employee contribution to PERS (e.g. 8% for "miscellaneous" members; 9% for "safety" members), the City shall immediately begin paying the aforementioned 8% on the employee's behalf. • If the City dose not come to an agreement with any bargaining unit or group within 60 days after the expiration of their contract the City shall immediately begin paying the aforementioned 8% PERS on the employee's behalf. J • Unit employees will pay an amount of the employee's share of PERS equal to the amount being paid by miscellaneous, sworn police and fire employees not to exceed 8%. In the event miscellaneous, police or fire employees receive other salary or benefit compensation in exchange for paying toward the employee share of PERS, unit employees shall receive "in kind" compensation. • Should any other City Bargaining Unit or group receive a wage/benefit increases during the term of this agreement, the City shall apply such increases to the General Bargaining Unit. 9
