Resolution - 2012-84RESOLUTION NO.2012-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA,' APPROVING GENERAL PLAN AMENDMENT NO.08-02 GENERAL PLAN AMENDMENT NO. 08-02 MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: City of West Covina LOCATION: Citywide WHEREAS, the City of West Covina has prepared an updated version of the Housing Element of the West Covina General Plan and proposes to adopt this update as an amendment to the, General Plan; and WHEREAS, the Housing Element Update policies require modifications to the Land Use Element of the General Plan, and the City has prepared necessary revisions to the Land Use Element; and WHEREAS, the proposal includes a change to the land use designation from: "Regional Commercial", "Service and Neighborhood Commercial", "Offices", "Mixed Use" and "Public Facilities" on that certain property generally describe, in Exhibit A; and . t WHEREAS, the Housing Element Update has been prepared in accordance with the requirements of State law; and WHEREAS, the proposed Housing Element Update and revisions to the Land Use Element maintain internal consistency within the General Plan; and WHEREAS, the Planning Commission, upon giving the required notice, did on the 23rd day of October, 2012, conduct a duly noticed public hearing to consider the subject application for a General Plan Amendment, at. which time the Planning Commission adopted Resolution No. 12-5484 recommending approval to the City Council; and WHEREAS, the City Council did, on the 201" day of November, 2012, conduct a duly advertised public hearing as prescribed by law, and considered evidence presented by the Planning Commission, Planning Department, and other interested parties. WHEREAS, studies and investigations made by this Commission and in its behalf reveal the following facts: 1. Government Code Section 65302 (c) requires all cities to have a Housing Element as a mandatory element of its General Plan. 2. Every city and county in California is required by Government Code Section 65588 to update its Housing element every five years. The Housing Element sets forth goals, policies and. programs to encourage the maintenance and expansion of the City's housing supply in order to adequately house people currently living and expected to live in the City; 3. The Element has been prepared following the State of California Housing Element Guidelines; 4. The. Draft of the Housing Element Update has been prepared for the City of West Covina as set forth in attached Exhibit "B," which is incorporated by reference (the "Element"); 5. The Land Use Element revisions have been prepared as set forth in attached Exhibit "C". creating the "Central Business District/Mixed Use Development" General. Plan Land Use Designation; and Resolution No. 2012-84 Page 2 6. Notice for the City'Council's consideration of the Housing Element was provided pursuant to Government Code Section 65090; and 7. A Mitigated Negative Declaration of Environmental Impact was prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended. NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION 1: Based on the evidence presented, both oral and documentary, the City Council approves General Plan Amendment No. 08-02 updating the Housing Element attached as Exhibit B and modifying the text of the Land Use Element attached as Exhibit C, thereby rescinding the current Housing Element of the General Plan adopted February 6, 1995, and adopting the updated Housing Element; and amending the land use designation of the Central Business District as set forth on the Land Use Map as depicted on Exhibit D; and SECTION 2: Pursuant to the requirements of the California Environmental Quality Act (CEQA) of 1970, a MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT has been prepared indicating that although the project could have a significant effect on the environment, there will not be a significant effect due to mitigating measures.
