Resolution - 2007-80• 0 RESOLUTION NO.2007-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A QUIT CLAIM DEED IN FAVOR OF RENE ORTIZ The City Council of the City of West Covina does resolve as follows: SECTION 1. The City Council of the City of West Covina, California, does hereby find and determine that the Quit Claim Deed be executed in favor of Rene Ortiz for certain City owned property as described in the attached Exhibit "A" and by reference hereto be made a part thereof. SECTION 2. The Mayor and City Clerk are hereby authorized and instructed to execute in the name of the City of West Covina, California, a Quit Claim Deed in favor of Rene Ortiz. SECTION 3. The City Clerk shall certify to the adoption of this resolution. Yauchzee, Director/City Engineer Public Works Department SUBJECT: SALE OF EXCESS RIGHTS -OF -WAY • NORTHWEST CORNER OF LARK ELLEN AVENUE AND SOUTH GARVEY AVENUE RECOMMENDATION: It is recommended that the City Council take the following actions: 1. Approve the sale of the excess rights -of -way on the northwest corner of Lark Ellen Avenue and Garvey Avenue South. 2. Adopt the following resolution: RESOLUTION NO. aM0 - YQ - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A QUIT CLAIM DEED IN FAVOR OF RENE ORTIZ DISCUSSION: On June 12, 2007, the Planning Commission approved Rene Ortiz to construct a 9,957-square foot office building on his parcel on the northwest corner of Lark Ellen Avenue and South Garvey Avenue. This property was a remnant parcel that was leftover because of the construction of the San Bernardino Freeway and has since remained vacant. Rene Ortiz is seeking approval to purchase portion of the existing rights -of -way along the west side of Lark Ellen Avenue adjacent to his parcel south of the San Bernardino Freeway. This portion of the existing rights -of -way is a landscaped slope adjacent to Lark Ellen Avenue maintained by the City. The size of the excess the rights -of -way being considered is 4,499 square feet (see attached sketch). The City's Master Plan of Streets classifies Lark Ellen Avenue as a minor arterial with an ultimate rights -of -way width of 80 feet. Presently, the existing rights -of -way along Lark Ellen Avenue from San Bernardino Freeway to South Garvey Avenue vary from 100feet to 130 feet. A large portion of the existing rights -of -way consists of landscaped slopes maintained by the City. These slopes were relinquished by the State to the City when the construction of the San Bernardino Freeway was completed. At this time, any portion of the rights -of -way that is beyond the ultimate rights -of -way of 80 feet can be identified as excess and can be sold to the adjacent property owners at a token price of $1.00 plus the cost for staff to review the Iegal description, plates, and prepare the quit claim deed in the amount of $872. The selling of the excess rights -of -way to Rene Ortiz will relieve the City from the responsibility for maintaining the landscape and irrigation. The sale of the excess rights -of -way will save the •City approximately $400 per year in maintenance costs. Rene Ortiz will continue to maintain the landscaped slopes. However, the parking lots can be constructed closer to the top of the slopes since the slopes themselves will serve as the required landscaped buffer between the parking lots and the public street. ALTERNATIVES: City Council may choose to not sell the excess rights -of -way. However, there is no reason to retain the excess rights -of -way. The City will also be relieved of the costs to maintain the slope area along Lark Ellen Avenue, which is estimated at $400 per year. This estimated cost is based on the City's present average of $300 per acre per month for landscaped and irrigated areas.
