RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA APPROVING THE APPLICATION FOR GRANT FUNDS
FROM THE NATIONAL BROWNFIELDS PROGRAM CLEANUP
GRANT FOR THE WEST COVINA GOLF COURSE PROJECT
�• WHEREAS, the "Small Business Liability Relief and Brownfields Revitalization Act'
expands potential federal financial assistance for Grants to state, local and non-profit
organizations to be utilized for brownfields revitalization; including assessment and cleanup
activities at brownfields sites; and
WHEREAS, the United States Environmental Protection Agency has been delegated the
responsibility for the national administration of the program, setting up necessary procedures
governing Project Application under the program; and
.WHEREAS, said procedures established by the United States Environmental Protection
Agency require the applicant to certify by resolution the approval of applications before
submission of said applications to the agency; and
WHEREAS, the City as Applicant will enter into a Contract with the United States
Environmental Protection Agency to complete the Project; and
WHEREAS, the City will commit matching funds equal to twenty percent (20%) of the
total amount awarded to the City if this grant is approved.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of West
Covina hereby:
1. Approves the filing of an application for National Brownfields Program cleanup
grant; and
2. Certifies that said Applicant has or will have available prior to commencement of any
work on the Project included in this Application, sufficient funds to operate and
maintain the Project, including the amount 'of twenty percent (20%) of the total
amount awarded to the City if this grant is approved; and
3. Certifies that the Grantee has reviewed, understands, and agrees to the General
Provisions contained in the Contract shown in the Procedural Guide; and
4. Appoints the City Manager as agent to conduct all negotiations, execute and submit
all documents, including, but not limited to applications, agreements, amendments,
payment requests and other documents, which may be necessary for the completion
of the Project; and
5. Agrees to comply with all applicable federal, state and local laws, ordinances, rules,
regulations and guidelines.
