A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT
NO. 06-04

NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT
APPLICANT: Charles Mautz
LOCATION: 850-856 Sunset Avenue
WHEREAS, the applicant has requested that the Planning Commission consider the
redesignation of land use as set forth in the General Plan from:
"Low Medium Residential" (4.1 to 8.0 dwelling units per acre) to "Medium High Density
Residential" (15.1 to 20 dwelling units per acre), on that certain property generally
described as:
Assessor Parcel Nos. 8469-001-010, 8649-001-009 in the records of the Los Angeles
County Assessor; and
WHEREAS, the requested General Plan amendment has been proposed to facilitate the
development of a 20-unit condominium development; and
WHEREAS, consistent with this request, the applicant has also requested a zone change
from "Residential Agricultural" (R-A) to "Multiple -family Residential" (MF-20); and
WHEREAS, a precise plan for the site plan and architecture has been submitted for the
development of the project; and
WHEREAS, a tentative tract map has been submitted, for the subdivision of the site into
20 condominiums; and
WHEREAS, a variance has been submitted to deviate from code requirements including
maximum ground coverage, second -story setbacks, building separation, and minimum dimension
requirements for recreation -leisure space; and
WHEREAS, the proposed development will result in a net density of 18.6 dwelling units
per acre; and
WHEREAS, it is a stated goal of the Housing Element of the General Plan "to provide all
residents of West Covina with opportunities to live in decent, safe, sanitary and energy efficient
housing at costs they can reasonably afford"; and
WHEREAS, it is a stated goal of the Housing Element of the General Plan to "identify all
sites, vacant or developed with a potential for residential development, and encourage their
efficient and attractive use'; and
WHEREAS, it is a stated policy of the Housing Element of the General Plan to
"encourage the construction of a wide variety of new housing to meet the needs of all residents";
and
WHEREAS, the Planning Commission, upon giving the required notice, did on the 13°i
day of March, 2007 conduct a duly advertised public hearing to consider the subject application
for a General Plan amendment, at which time the Planning Commission adopted Resolution No.
1 07-5212 recommending denial of a change in land use designation to "Medium I-ligh Density
Residential" (15.1 to 20.0 dwelling units per acre) as requested by the applicant; and
WHEREAS, the City Council did, on the 3"1 day of April, 2007, conduct a duly
advertised public hearing as prescribed by law, and considered evidence presented by the
Planning Commission, Planning Department, and other interested parties.

NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve
as follows:
SECTION 1: Based on the evidence presented, both oral and documentary, the City

ouncil hereby approves General Plan Amendment No. 06-04, amending the land use
signation for the subject property as set forth on the Land Use Map of the Land Use Element
depicted on Exhibit A to change the land use designation to "Medium High Density
Residential' (15.1 to 20.0 dwelling units per acre); and
SECTION 2: Pursuant to the California Environmental Quality Act (CEQA) of 1970, A
Negative Declaration of Environmental Impact has been prepared.
SECTION 3: The City Clerk shall certify to the passage of this Resolution.
