Resolution - 2006-85RESOLUTION NO.2006-85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, EXPRESSING SUPPORT FOR PROPOSITION 83 (a.k.a., "JESSICA'S LAW"), AND AUTHORIZING STAFF TO UNDERTAKE APPROPRIATE ACTIONS CONSISTENT THEREWITH WHEREAS, in 1999 the State of California enacted Sections 290 and 290.4 of the Penal • Code (commonly known as "Megan's Law") to protect the public against sex offenders; and WHEREAS, Megan's Law has been amended at various times over the past seven years to establish greater restrictions on paroled sex offenders, with the goal of strengthening protections that the law affords to children and others; and WHEREAS, in order to further advance the protections established by Megan's Law and its amendments, a ballot initiative known as The Sexual Predator Punishment and Control Act of 2006 (commonly known as "Jessica's Law") was filed with the California Attorney General's Office on July 22, 2005. The initiative was thereafter qualified by the California Secretary of State to appear on the November 2006 general election ballot as Proposition 83 (hereafter, "Prop 83"); and WHEREAS, Prop 83 would strengthen the protections established under Megan's Law by, inter alia: (1) increasing to 2,000 feet the distance from any school or park that sex offenders could reside; (2) authorizing cities to establish additional sites subject to sex offender distance requirements; (3) requiring felony sex offenders to wear GPS tracking devices which would enable monitoring of their locations and movements; and (4) increasing certain parole and sentencing terms for convicted sex offenders; and WHEREAS, the League of California Cities, along with numerous cities and counties throughout the State, have formally endorsed Prop 83; and WHEREAS, the City'Council is supportive of the objectives of Prop 83, and desires to facilitate the changes in law that would be enacted by Prop 38 in order to advance the legal protections afforded to children and others against sex offenders. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of West Covina as follows: SECTION 1. On behalf of the City of West Covina, the City Council hereby formally endorses Prop 83. SECTION 2. The City Council directs City officials and staff to take appropriate steps to register the City's endorsement of Prop 83. Such steps include, but need not be limited to, execution of a support letter to the Prop 83 campaign on behalf of the City, and causing the City of West Covina to be officially named as a supporter of Prop 83. SECTION 3. The City Council hereby delegates to the Chief of Police the 'authority to execute all documents on behalf of the City consistent with this Resolution. SECTION 4. The City Clerk shall certify the passage and adoption of this Resolution and it shall thereupon be in full force and effect. APPROVED and ADOPTED on the 17`h day of October 2006.
