Resolution - 2006-81RESOLUTION NO.2006-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO.06-02 AND WESTSIDE AREA PLAN AMENDMENT NO.6 GENERAL PLAN AMENDMENT NO. 06-02 .WESTSIDE AREA PLAN AMENDMENT NO.6 CATEGORICAL EXEMPTION APPLICANT: Conrad Banks LOCATION: 845 S. Sunkist Avenue WHEREAS, the applicant has requested that the City Council consider establishing a land use designation of: General Plan designation from "Service and Neighborhood Commercial' to "Low Medium Residential' (4.1-8.0 dwelling units per acre) Westside Area Plan designation from "Service and Neighborhood Commercial' to "Low Medium Residential' (4.1-8.0 dwelling units per acre) as indicated on Exhibit A, on that certain property generally described as: Assessor Parcel Nos. 8468-003-001, as shown on the latest rolls of the Los Angeles County Tax Assessor; and WHEREAS, the existing zoning classification of "Single -Family Residential' (R-1), Area District I is consistent with the proposed "Low Medium Residential' (4.1 to 8.0 dwelling units per acre) General Plan and Westside Area Plan designations; and WHEREAS, consistent with this request, a parcel map has been approved by the Planning Commission for the subdivision of the site into three single-family residential lots; and WHEREAS, consistent with this request, a variance has been approved allowing for deviations from certain development standards; and WHEREAS, the proposed development will result in a density of 5.2 dwelling units per acre, overall; and WHEREAS, it is a stated goal of the Housing Element of the General Plan "to provide all residents of West Covina with opportunities to live in decent, safe, sanitary and energy efficient housing at costs they can reasonably afford"; and WHEREAS, it is a stated goal of the Housing Element of the General Plan to "identify all sites, vacant or developed with a potential for residential development, and encourage their efficient and attractive use;" and WHEREAS, it is a stated policy of the Housing Element of the General Plan to "encourage the construction of a wide variety of new housing to meet the needs of all residents"; and WHEREAS, the Planning Commission upon giving the required notice did on the 26`h day of September, 2006, conduct duly advertised public hearings as prescribed by law to consider said application; and WHEREAS, the Planning Commission did adopt Resolution No. 06-5172 recommending approval of the General Plan and Westside Area Plan amendments; and WHEREAS, the City. Council did, on the 171h day of October, 2006, conduct a duly advertised public hearing as prescribed by law, and considered evidence presented by the Planning Commission, Planning Department, and other interested parties. Resolution No. 2006-81 October 17, 2006 E 0 NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION 1: Based on the evidence presented, both oral and documentary, the City Council approves General Plan Amendment No. 06-02 and Westside Area Plan Amendment No. 6, amending the land use designation for the subject property as set forth on the Land Use Map of the Land Use Element as depicted on Exhibit A. SECTION 2: Pursuant to the California Environmental Quality Act (CEQA), the proposed project is considered to be categorically exempt (Class 15, Section 15315- Minor Land Divisions) in that it consists of a subdivision of a certain property in an urban area into less than four parcels. PASSED and APPROVED on this 171h day of October, 2006.
