Resolution - 2006-45RESOLUTION NO. 2006-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING CORTEZ PARK MASTER PLAN NO.9 • CORTEZ PARK MASTER PLAN AMENDMENT NO. 9 CATEGORICAL EXEMPTION APPLICANT: City of West Covina LOCATION: Cortez Park 2441 East Cortez Street WHEREAS, on June 18, 1977, the City Council adopted the Cortez Park Specific Plan; and WHEREAS, the park is currently developed with amenities which include a senior citizen center, two baseball fields, a multi -purpose field, a tot lot and play area, picnic shelters, restroom facilities, a fire station and public parking; and WHEREAS, a request has been initiated to allow the extension of the evening use of the sports field and sports field lighting at Cortez Park from 9:00 p.m. to 10:00 p.m.; and WHEREAS, the Community Services Commission and Planning Commission, upon giving the required notice, did on the 23`d day of May, 2006, conduct a duly advertised public hearing as prescribed by law to consider said application; and WHEREAS, the City Council did, upon giving the required notice, on the 61h day of June, 2006, conduct a duly advertised public hearing as prescribed by law to consider said request; and WHEREAS, based on the evidence presented to the City Council, both oral and documentary, the City Council finds as follows: 1. The proposed amendment is consistent with the City's General Plan policy for development of a community park. 2. The proposed amendment is consistent with the General Plan Environmental Quality Element which adopts, as goals, the provision of "adequate recreational facilities and programs for the citizens of West Covina and "the periodic evaluation of the facilities in parks." 3. The project is a Categorical Exemption, Class 1 (Section 15332: Existing facilities) pursuant to the requirements of the California Environmental Quality Act of 1970 (CEQA) since the project site involves the use of existing lighting fixtures at Cortez Park. NOW THEREFORE, the City Council of the City of West Covina does resolve as follows: On the basis of the evidence presented, both oral and documentary, the City Council of the City of West Covina does hereby approve Cortez Park Master Plan No. 9, subject to the following • conditions: a. Sports field lights shall beset to automatically turn off by no later than 10:00 p.m. b. Facility Use Agreements shall specify that games shall cease no later than 9:30 p.m. c. These conditions shall supercede conditions g. and j. of the City Council Resolution No. 9190 approving Cortez Park Master Plan Amendment No. 7. All other conditions of said resolutions shall remain in effect. Resolution No. 2006-45 June 6, 2006 C] That the City Clerk shall certify to the adoption of this resolution.
