A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, DENYING GENERAL PLAN AMENDMENT
NO. 05-06

CATEGORICAL EXCEPTION
APPLICANT: Rowland Unified School District
LOCATION: 401 S. Nogales Street, Nogales High School

WHEREAS, the applicant has requested that the City Council consider establishing a
land use designation as set forth in the General Plan of:
"Public Facilities, High School," on that certain property generally described as:
Assessor Parcel No. 8725-005-906, as shown on the latest rolls of the Los Angeles
County Tax Assessor; and
WHEREAS, the requested General Plan amendment has been proposed in conjunction
with the pending annexation of Nogales High School into the City of West Covina; and
WHEREAS, consistent with this request, the applicant has also requested a zone change
to establish a zoning designation of "Public Building" (P-B); and
WHEREAS, it is a stated policy of the Human Resources Element of the General Plan to
"Ensure that the human service needs of all City residents are being met in a satisfactory and
effective manner"; and
WHEREAS, the Planning Commission upon giving the required notice did on the 14`h day
of February, 2006, and the 28`h day of February, 2006, conduct duly advertised public hearings as
prescribed by law to consider said application; and
WHEREAS, the Planning Commission did adopt Resolution No. 06-5110 recommending
denial of the General Plan amendment; and
WHEREAS, on March 3, 2006, an appeal of the Planning Commission action was filed
by Ronald Vera; and
WHEREAS, the City Council did, on the 41h day of April, 2006, conduct a duly
advertised public hearing as prescribed by law, and considered evidence presented by the
Planning Commission, Planning Department, and other interested parties.
NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve
as follows:
SECTION 1: Based on the evidence presented, both oral and documentary, the City
Council denies General Plan Amendment No. 05-06. ,
