Resolution - 2006-23RESOLUTION NO. 2006-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA DECLARING ITS SUPPORT FOR AB 2923 - REIMBURSEMENT OF COSTS FROM MINORS THAT COMMIT GRAFFITI AND VANDALISM WHEREAS, existing law cities and counties are authorized to adopt an ordinance to • recoup through juvenile court proceedings the communities costs associated with defacement by minors of its property and the property of others by graffiti or other inscribed material; and WHEREAS, minors who commit specified acts of vandalism are required to provide restitution and makes the parents of such a minor liable for specified costs and damages caused by the minor, as determined by the court. Currently, the Department of Motor Vehicles (DMV), if requested by specified local communities, to impose and collect surcharges and fees on the registration or renewal of motor vehicle registrations; and WHEREAS, existing law allows the courts to suspend or delay an individual, convicted of committing vandalism or graffiti, their driver's license for one year; and WHEREAS, AB 2923 combines the existing laws and specifically gives the DMV the authority to collect all of the costs imposed upon a minor, the minor's estate, or the minor's parents pursuant to specified provisions related to graffiti abatement, upon the registration or renewal of registration of a motor vehicle; and WHEREAS, AB 2923 allows the courts to suspend or delay an individual, convicted of committing vandalism or graffiti, their driver's license for up to three years. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST COVINA AS FOLLOWS: SECTION 1. The City of West Covina hereby declares its support for AB 2923 - Reimbursement of Costs from Minors that Commit Graffiti and Vandalism. SECTION 2. That the City Clerk shall certify to the adoption of this Resolution and forward a copy to the following entities: League of California Cities, and all State elected officials representing West Covina, and Assemblyman Ron Calderon. SECTION 5. That this resolution shall become effective immediately upon passage and adoption.
