Resolution - 9739RESOLUTION NO.9739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. III-99-34. iGENERAL PLAN AMENDMENT NO. III-99-34 CATEGORICAL EXEMPTION APPLICANT: City of West Covina LOCATION: 305, 315, 333 and 345 N. Citrus Street 2525, 2529, and 2533 E. Workman Avenue WHEREAS, the applicant has requested that the City Council consider the re - designation of land use as set forth in the General Plan from: "Regional Commercial" to "Service and Neighborhood Commercial" (Exhibit 1) on that certain property generally described as: Assessor Parcel Nos. 8453-001-007, 010, 021, 047, 048, 049, 902, and 904, as shown on the latest rolls of the Los Angeles County Tax Assessor; and WHEREAS, consistent with this request, the applicant has also requested a zone change from "Medium Commercial' (C-2) to "Service Commercial' (S-C); and WHEREAS, on July 13, 1999, the Planning Commission was addressed by the owner of an auto body shop located at a "C-2" zoned property at 2525 E. Workman Avenue (north of Workman Avenue and west of Citrus Street); and WHEREAS, under the "C-2" Zone, Precise Plan No. 543 was approved to allow the easterly portion of the subject property to be used for an auto sales business as a primary use and an auto repair/auto body business as an accessory use to the auto sales use; and WHEREAS, the auto sales use is no longer in operation at the site, thereby posing an issue concerning the continued operation of an auto repair and auto body business; and WHEREAS, the property owner has expressed a desire to continue operating his auto repair/auto body business at its present location while having the option to recruit uses other than auto sales; and WHEREAS, the Planning Commission directed staff to evaluate possible options to address this situation; and WHEREAS, On July 27, 1999, the Planning Commission held a study session at which time, the Planning Commission directed staff to initiate a general plan amendment and zone change for the subject property from "Regional Commercial' to "Service and • Neighborhood Commercial' and a zone change from "Medium Commercial" (C-2) to "Service Commercial" (S-C); and WHEREAS, on August 10, 1999, the Planning Commission adopted Resolution No. 08-99-4561 initiating an application for Zone Change No. 667 and General Plan Amendment No. III-99-34; and C:\WFNDOWS\TEMP\GPAIII-99-34.doc N/W Corner of Citrus and Workman General Plan Amendment No. 111-99-34 December 7, 1999 - Page 2 WHEREAS, the Planning Commission, upon giving the required notice, did on the 23`d day of November, 1999, conduct a duly advertised public hearing to consider the subject application for a General Plan Amendment, at which time the Planning Commission adopted Resolution No. 11-99-4580, recommending to the City Council approval of General Plan Amendment No. III-99-34; and WHEREAS, the City Council did, on the 7th day of December, 1997, conduct a duly advertised public hearing as prescribed by law, and considered evidence presented by the Planning Commission, Planning Division, and other interested parties. WHEREAS, the studies and investigations made by the Planning Commission and City Council and in their behalf reveal the following facts: 1. The general plan amendment from "Regional Commercial" to "Service and Neighborhood Commercial" is necessary in order to establish a land use designation which best fits the character of the land uses which currently occupy the subject site, as well as establish a land use designation which reflects the City's goals and policies for future uses and development of the subject site. 2. The Land Use Element of the West Covina General Plan states that the purpose of the existing "Regional Commercial" classification is to identify areas that should be developed with facilities of regional significance providing a . complete line of shop and store types, restaurant and entertainment facilities, as well as business and financial services intended to serve the general area of the East San Gabriel Valley region. 3. The predominant mix of auto repair/auto oriented uses currently located at the subject site does not fit with the nature of uses intended under the "Regional Commercial" land use designation. 4. The Land Use Element of the West Covina General Plan states that the purpose of the proposed "Service and Neighborhood Commercial" classification is to provide for the development of trade and business uses, which by their nature are of a moderate to relatively high intensity. 5. - The "Service Commercial" component of this land use designation provides for high intensity commercial uses such as the existing auto dealership, service station and auto repair uses, which depend on direct motorist exposure and excellent access. 6. Based on the above facts the "Service and Neighborhood Commercial" land use designation is a most appropriate designation available for the existing service oriented land uses (including auto repair) and future land uses of a similar nature and is in good interest of the City generally. 7. The general plan amendment will not negatively affect properties either in value or material enjoyment in that the existing "Regional Commercial' land use designation provides for uses as intense or more intense in some instances than the proposed "Service and Neighborhood Commercial" land • use designation. Moreover, no physical development of property is proposed in conjunction with the general plan amendment. NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION 1: Based on the evidence presented, both oral and documentary, the City Council hereby approves General Plan Amendment No. III-99-34, amending the land C:\WINDOWS\TEMP\GPAIII-99-34.doc N/W Corner of Citrus and Workman General Plan Amendment No. 111-99-34 December 7, 1999 - Page 3 • use designation for the subject property as set forth on the Land Use Map of the Land Use Element as depicted on Exhibit 1; and SECTION 2: Pursuant to the California Environmental Quality Act (CEQA) of 1970, the proposed general plan amendment is considered to be categorically exempt (Class 5, Minor Alterations to Land Use Limitations) in that it results in a minor alteration to the current land use designation in an area with an average slope of less than 20 percent, and which does not result in any changes in the existing commercial land use or density. SECTION 3: The City Clerk shall certify as to the passage of this Resolution. PASSED AND APPROVED on this 7th day of December, 1999.
