Resolution - 9738I RESOLUTION NO. 9738 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, OVERTURNING A PLANNING COMMISSION DECISION AND APPROVING A DEVIATION FROM THE WEST COVINA VILLAGE SIGN CRITERIA FOR A • TENANT IDENTIFICATION SIGN AT 341 NORTH AZUSA AVENUE. WHEREAS, the applicant has appealed to the City Council to consider overturning a Planning Commission decision to deny a proposed deviation from the West Covina Village Sign Criteria: on that certain property generally described as: Assessor Parcel Nos. 8455-001-023, as shown on the latest rolls of the Los Angeles County Tax Assessor; and WHEREAS, the applicant is requesting to locate a proposed tenant identification wall sign on the upper brick fagade above their tenant space (341 North Azusa Avenue) because the plaster sign band designated for their tenant space is interrupted by a column element, which would necessitate splitting the proposed sign into two sections; and WHEREAS, in developing a sign program for the West Covina Village, it was recognized that larger (or "major") tenants should be provided with greater sign area than could be accommodated on the stucco sign band area; and WHEREAS, a "major" tenant, defined as a tenant occupying a floor area greater than 5,000 square feet, may locate their tenant identification signs on the upper brick fagade, of the in -line tenant buildings within the center; and WHEREAS, the appellant (North American Mortgage) occupies an in -line tenant space of approximately 4,000 square feet in area and is not considered a "major" tenant; and WHEREAS, North American Mortgage is required under the West Covina Village Sign Criteria to locate their tenant identification sign on the plaster sign band; and WHEREAS, reducing the size of the sign to fit within the available uninterrupted portion of the plaster sign band would make the sign too small for adequate visibility; and WHEREAS, the fact that the designated plaster sign band space for this tenant space is interrupted by both an angled bend and a brick column serve to significantly reduce the area within which a sign can be placed; and WHEREAS, the proposed sign otherwise complies with the sign standards of the West Covina Municipal Code; and WHEREAS, on August 12, 1999, North American Mortgage requested approval of a deviation from the West Covina Village Sign Criteria to place their tenant identification sign on the brick fagade; and • WHEREAS, the City Planner denied the requested deviation as it was determined that there was sufficient justification for the deviation; and WHEREAS, on August 26, 1999, North American Mortgage filed an appeal of the City Planner's denial of the requested deviation to the Planning Commission; and Z:\City Council\Resosdd\N.American Appeal.approval.doc North American Mortgage Sign Appeal November 16, 1999 - Page 2 WHEREAS, the Planning Commission, upon giving the required notice, did on the 28th day of September, 1999, considered an appeal of a City Planner's decision to deny the requested deviation from the West Covina Village Sign Criteria; and WHEREAS, the Planning Commission upheld the City Planner's decision to deny • the requested deviation; and WHEREAS, on October 7, 1999, North American Mortgage filed an appeal to the City Council to consider overturning the Planning Commission decision to deny the requested deviation; and 11 WHEREAS, the City Council did, on the 16th day of November, 1999, conduct a duly advertised public hearing as prescribed by law, and considered evidence presented by the Planning Commission, Planning Division, and other interested parties; NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION 1: Based on the evidence presented, both oral and documentary, staff and the Planning Commission overturns the Planning Commission decision and approves the requested deviation from the West Covina Village Sign Program; and SECTION 2: The project is categorically exempt pursuant to the provisions of the Section 15301 (Existing Facilities) of the California Environmental Quality Act of 1970, as amended; and SECTION 3: The City Clerk shall certify as to the passage of this Resolution.
