Resolution - 9714RESOLUTION NO. 9714 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND APPROVING PRECISE PLAN NO.871 AND TREE REMOVAL PERMIT NO. 21. • WHEREAS, there was filed with this Commission a verified application on the forms prescribed in Chapter 26, Article VI of the West Covina Municipal Code, requesting approval of a precise plan to: Carry out the Amended and Restated Development Disposition and Owner Participation Agreement (ARDDOPA), and allow the approval of a precise plan to allow the expansion of an existing automobile dealership, modify an existing dealership (formerly West Covina Saturn) relative to site access and on -site circulation and parking. In addition, the currently separate sites would be consolidated under one precise plan due to their inter -relatedness. The precise plan application is accompanied by Tree Removal Permit No. 21 for the removal of up to 10 significant trees in the "Service -Commercial (S-C) Zone" on that certain property generally described as follows: Los Angeles County Assessor's Parcel Numbers 8478-004-028, 029,030, 031, 032, 033„ 039, and 908 and 8478-007-902; and WHEREAS, the Planning Commission at a duly authorized public hearing on the 6"' day of July, 1999, did adopt Resolution No. 07-99-4556 approving Precise Plan No. 871 and Tree Removal Permit No. 21; and WHEREAS, on July 7, 1999, Hassen Imports Partnership filed an appeal of the Planning Commission's July 6, 1999, action to the City Council regarding a condition regulating vehicle test driving; and WHEREAS, this appeal-de-novo has been noticed as required by the West Covina Municipal Code (WCMC) and other laws for modification of a precise plan; and WHEREAS, studies and investigations made by this Commission and in its behalf reveal the following facts: 1. The applicant is requesting approval of a revision to a precise plan to allow the expansion of the expansion of an existing automobile dealership, modify an existing dealership (formerly West Covina Saturn) relative to site access and on -site circulation and parking. In addition, the currently separate sites would be consolidated under one precise plan due to their inter- relatedness. The precise plan application is accompanied by Tree Removal Permit No. 21 for the removal of up to 10 significant trees. 2. The project as designed with conditions of approval, meets and exceeds the development standards of the "Service Commercial (S-C) Zone." 3. The project has been designed in a manner sensitive to surrounding land uses through the design and placement of the proposed buildings, the architectural design of the buildings, the placement of landscape to assist in softening the appearance of the development from • the single-family residences to the south and conditions of approval. 4. Approval of the requested precise plan will in no way be detrimental to adjacent properties. 5. The project is consistent with the General Plan land use designation of "Service and Neighborhood Commercial." 6. That consideration has been given and restrictions imposed to the extent necessary to permit the same degree of enjoyment of the subject property, but subject to the • same degree of protection of adjoining properties, as would be accorded in normal circumstances, by the standard restrictions imposed by the Municipal Code. b. That strict adherence to the development standards of the applicable zone and the proposed precise plan will not measurably depreciate property values in the vicinity or interfere with the use or enjoyment of property in the vicinity or endanger the public peace, health, safety or general welfare. C. That the project is reviewed in terms of its architectural design, general exterior appearance, landscaping, color, texture of surface materials and exterior construction, shape and bulk and other physical characteristics including location and type of public utility facilities and is found to facilitate the orderly development of the precise plan area. 7. Pursuant to the requirements of the California Environmental Quality Act (CEQA) of 1970, a Mitigated Negative Declaration of Environmental Impact has been prepared and certified indicating that although the project could have a significant effect on the environment, there will not be a significant effect due to mitigating measures. NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: 1. On the basis of the evidence presented, both oral and documentary, the Planning Commission makes the following findings: a. The proposed project meets the minimum requirements of the "Service Commercial" (S-C) Zone. The project has been designed with conditions of approval, in a manner that is compatible with the existing automobile dealerships and the design character of the "Auto Plaza." The demolition of the six (6) existing single-family residences and the development of the vacant portion of the site will facilitate the completion of the development of the "Auto Plaza" as currently envisioned in a manner compatible with • adjacent automobile dealerships. In addition, implementation of the project will facilitate the completion of the landscape and parkway treatment established along Norma Avenue on the south. The architectural style of the proposed expansion and new dealership is compatible in terms of building mass, colors, materials and architectural features as the existing dealership. Landscaping on the site exceeds the minimum requirements with specific attention directed toward the landscape treatment along Norma Avenue and adjacent to the parking structure. Planting of specimen size landscape materials in this area will assist in softening the appearance of the buildings from the existing single-family residences and mitigation measures are included in the environmental analysis requiring such planting. Where possible, the existing mature trees that are healthy and aesthetically viable will be preserved and utilized in the landscape design to provide the desired aesthetic screening. In addition, the • removal of each significant tree will require replacement planting at a two -to -one ratio (24-inch, 36-inch box or larger). b. Implementation of the proposed project will not measurably depreciate property values or interfere with the use or enjoyment of property in the vicinity as the site was previously planned for development of an automobile dealership including a three-story parking structure at the rear of the site along Norma Avenue. The tallest portion of the development is located more proximately to Garvey Avenue, away from the single-family residences to the south. The • continuation of the landscape and sidewalk treatment along Norma Avenue will result in a cohesive design and will complete the parkway and planting treatment as currently planned and previously approved. The proposed buildings comply with the minimum setback requirements and are designed in a manner that is architecturally compatible with the existing automobile dealerships utilizing similar materials and colors. c. The proposed building expansion to the existing West Covina Dodge facility is located south of the existing dealership and service building and thus is not readily visible from adjacent properties to the east, south and west. The building is designed with the same materials and finishes as the existing service building. The proposed dealership expansion is also designed with materials matching the existing West Covina Dodge dealership building, which is compatible with the modern architectural design concept for the "Auto Plaza." Development of the site in the proposed project is consistent with the plans for the "Auto Plaza" established in 1981 and subsequently revised to include the expansion areas. All utilities are in place to serve the proposed development. A minor extension of a storm drain will be installed concurrently with the construction of the project that will be partially funded by the applicant. 2. That pursuant to all of the evidence presented, both oral and documentary, and further based on the findings above, the decision of the Planning Commission is upheld and Precise Plan No, 871, and Tree Removal. Permit No. 21 are approved subject to the provisions of the West Covina Municipal Code, provided that the physical development of the herein described property shall conform to said plan and the conditions set forth herein which, except as otherwise expressly indicated, shall be fully performed and completed or shall be secured by bank or cash deposit satisfactory to the City Planner, before the use or occupancy of the property is commenced and before the Certificate of Occupancy is issued, and the violation of any of which shall be grounds for revocation of said precise plan by the Planning Commission or City Council. 3. That the precise plan shall not be effective for any purpose until the owner of the property involved (or a duly authorized representative) has filed at the office of the City Planner, his affidavit stating he is aware of, and accepts, all conditions of this precise plan as set forth below. Additionally, no permits shall be issued until the owner of the property involved (or a duly authorized representative) pays all costs associated with the processing of this application pursuant to City Council Resolution No. 8690. 4. That the approval of the precise plan is subject to the following conditions: a. Comply with Study Plan "A" (Sheets I — 3), dated, July 6, 1999. b. Comply with Exhibits 1 - 4 dated, July 6, 1999. C. Comply with all requirements of the "S-C" Zone. • d. Prior to the issuance of grading permits, the applicant shall submit three copies of detailed landscaping and irrigation plans to the Planning Division for review and approval. Said plan shall include type, size, and quantity of landscaping materials, as well as a fully automatic comprehensive watering system in compliance with the City's water efficient landscape requirements. Landscaping areas are to be kept free of litter and diseased or dead plants. Diseased, dead, damaged and/or disfigured plants shall be replaced as deemed necessary by the City Planner. Special attention shall be directed to the landscaping area • along Norma Avenue including the landscape planter along the single-family property immediately east of the parking structure. Said areas shall be landscaped utilizing specimen size plant materials (24 inch box and larger.) Also refer to Mitigation Measure t.xvii. e. All ground -mounted, wall -mounted and/or roof -mounted equipment not shown on the approved Study Plan and exhibits, shall be screened from all views, in a manner that is architecturally compatible with the main building. Plans and elevations indicating the type of equipment and method of concealment shall be submitted to the City Planner for review and approval prior to the issuance of building permits. f. All utilities shall be installed underground. g. The location of new electrical transformers and other mechanical equipment, if not indicated on the approved Study Plan, must be approved by the City Planner prior to the issuance of building permits. h. Gutters and downspouts shall not project from the vertical surface of the building pursuant to Section 26-568 (a) (3). i. Pole mounted parking lotlightingshall be accurately indicated on the grading plan and shall be located within landscaped or hardscaped area. Pole locations shall be accurately staked prior to installation by the Civil Engineer that prepared the grading plan. j. The approved use shall not create a public nuisance as defined under Section 15- 200 of the West Covina Municipal Code. k. All antenna and antenna support structures shall be placed and installed in a manner which screens at least 75 percent of the antenna when viewed from ground level from any adjacent public right-of-way or residentially zoned properties. Such screening may include landscaping, fencing, or walls, which have been integrated with the design of the building. In. Prior to the issuance of grading permits submit revised site plans, floor plans and building elevations for review and approval by the City Planner to check the site design and building architecture for compliance with the West Covina Municipal Code and appropriate design techniques. Said plans shall incorporate the required modifications to add an architecturally integrated opaque metal screen immediately above the parapet wall on the parking structure. n. The dealerships shall utilize the following routes for test driving service vehicles and new car demonstrations 1) San Bernardino Freeway by traveling west on East Garvey Avenue South from the site. At Azusa Avenue, vehicles would turn right • and travel north to the San Bernardino Freeway on -ramps. By heading east on the San Bernardino Freeway, the Citrus Street or Barranca Avenue exits could be used to make the return trip to the car dealership. The surface street route shall include East Garvey Avenue South, Hollenbeck Street, Cameron Avenue, and Azusa Avenue. Surface street routes shall be directed east on East Garvey Avenue South to Hollenbeck Street. At Hollenbeck Street, vehicles will turn right and head south to Cameron Avenue. At Cameron Avenue, turn right and head west to Azusa Avenue. Traveling east on East Garvey Avenue South the driver will return to the car dealership. o. Except where expressly modified by the conditions of this resolution, the applicant shall comply with the conditions of approval contained in City Council Resolution No.9452 for Precise Plan No. 767, Revision 2, City Council Resolution No. 8246 for Precise Plan No. 767, Revision 1, and Planning Commission Resolution No. 6-83-3244 for Precise Plan No. 767, and Variance No. 837. P. Final design plans for areas receiving special paving treatments shall be submitted to the Planning Division for review and approval prior to the issuance of building permits. A sample of the proposed material(s) shall also be submitted with said plan. q. Fencing utilized throughout the site shall be compatible with the building architecture and shall be reviewed and approved by the Planning Division, and Redevelopment Agency for architectural compatibility and location prior to issuance of building permits. r. The applicant shall meet any and all monitoring or reporting requirements necessary to ensure compliance with the mitigation measures contained in the Mitigated Negative Declaration of Environmental Impact as those may be determined by the City. Applicant's signature hereon constitutes his agreement to perform and/or monitor and report during project construction and implementation. The applicant further agrees it will cease construction of the project immediately upon written notice of a violation of such requirement and that such a provision may be part of any agreement of City and applicant. S. Comply with the mitigation measures as outlined in the Mitigated Negative Declaration of the Environmental impact dated June 16, 1999 and as follows: i. All on -site driveways and roadways shall be stop -controlled and all signing and marking shall conform with Caltrans Standard Plans dated 1997 and specifications dated 1995, Caltrans Traffic Manual, latest edition. ii. On -site parking stalls and drive aisles shall be constructed per City standards. iii. Construction traffic impacts on adjacent area roadways within the project vicinity shall be minimized. Prior to the issuance of grading or building permits, a construction management plan shall be prepared for review and approval by the City Engineer and City Planner prior to construction to address the following: a). The impact of additional construction -related trips (i.e. trucks and • construction employee trips) on the street system should be considered negligible since these trips can be scheduled and their frequency increased during off-peak (mid -day hours.) Excavation and hauling shall also be scheduled for mid -day, in order to reduce the residential and traffic impacts during construction. Excavation is not recommended on days with wind speeds in excess of 25 miles per hour. b). The specifics of a work zone traffic control plan, which includes the use of flagmen and lane channelization devices, shall be CAW INDO W SUEMPT871 RSCC.doc Resolution No. 9714 Precise Plan No. 871 Hassen Imports Partnership - West Covina Dodge July 20, 1999 - Page 6 established in accordance with City guidelines. Contractor traffic control plans will need to be approved by the City of West Covina. A flagman shall be available at all times to ensure vehicle and pedestrian safety, and be used whenever trucks entering or leaving the project site may impede the flow of traffic. The contractor shall ensure the safety of pedestrians by installing a construction fence on the project's perimeter. c). The contractor shall provide an estimate of truck volume and .schedule. Areas shall be approved by the City for staging of all trucks. All earth -moving and ready -mix trucks shall be equipped with two-way radios, in order for the drivers at the staging areas to be linked to a traffic controller at the job site. The trucks shall follow a City approved route to the job site. In order to minimize the impacts to the neighborhoods, construction traffic shall utilize Azusa Avenue to East Garvey Avenue South. d). The undercarriage and wheel areas of all trucks leaving the site during excavation operations shall be cleaned at least daily. Vehicle speeds shall be no greater than 15 miles per hour on unpaved roads. e). When feasible, materials being delivered to the site shall be scheduled with the least inconvenience to the public. The contractor shall have a designated employee controlling the logistics of all deliveries. All materials requiring assembly shall be accommodated on -site. f). Work zone traffic control shall comply with City guidelines. g). Construction traffic shall utilize City approved routes. It is suggested that Azusa Avenue and East Garvey Avenue South be used. h). Construction -elated parking shall be prohibited on all public street and shall be provided on -site. i). Construction -related parking (for construction employees) shall be prohibited on all public streets and be provided on -site. Parking and bicycle storage facilities shall be located on -site. Employees shall be encouraged to carpool and develop a trip reduction plan to achieve a 1.5 average vehicle ridership (AVR). The schedule of construction activities and locations of construction -related parking shall also be provided. iv. All equipment shall be properly tuned and maintained in accordance with manufacturer's specifications. V. General contractors shall maintain and operate construction equipment so as to minimize exhaust emissions. During construction equipment, trucks and vehicles in loading and unloading queues shall be kept with their engines off, when not in use, to reduce vehicle emissions. Construction emissions shall be phased and scheduled to avoid emissions peaks and discontinued during second -stage smog alerts. • vi. The project construction will be phased over an 18 to 24 month period as set out in the ARDDOPA. vii. Low -emission mobile construction equipment shall be utilized where feasible. Prior to the commencement of construction the applicant shall submit a plan specifying the type of vehicles and equipment, and the duration of' • usage throughout the course of construction. ix. The site shall be watered and construction equipment cleaned during morning and evening hours. X. Soil binders shall be spread on the site, unpaved roads, and parking areas. xi. Construct a 6-foot tall decorative masonry wall between the parking structure and Norma Avenue along the south property line in the manner directed by the Planning Commission, and as early in the construction process as is practicable. xii. Vehicle servicing shall only occur within the designated vehicle service bays as designated on the plans. xiii. No exterior public address or amplification devices shall be installed or utilized at the site. xiv. All mechanical equipment installed at the site shall be low noise generating equipment rated at less than 65 dBA within 100 feet of residential property or shall be effectively sound attenuated to minimize noise impacts to adjacent properties. xv. During initial construction, delivery of materials and equipment, outdoor operation of equipment, and outdoor use of hammers and power tools shall be limited to the hours between 7:00 a.m. and 7:00 p.m. xvi. Noise generating construction activity shall be limited to between the hours of 7:00 a.m. and 7:00 p.m., Monday through Friday: and 8:00 a.m. to 6:00 p.m. on Saturdays. xvii. The use of construction equipment shall be limited to the following: a. One -diesel powered tracked loader operating a maximum of five hours per day. b. One -diesel powered wheeled loader operating a maximum of five hours per day. C. One -diesel powered motor grader operating a maximum of five hours per day. d. 22 pieces of stationary equipment such as compressors and generators. e. Three -gasoline powered (50 horsepower) forklifts operating a maximum of eight hours per day. f. Three off -highway trucks operating for a maximum of five hours per day. • xviii The construction of a new 30-inch Hillward Street Storm Drain shall be completed prior to or concurrent with project construction pursuant to the West Covina Master Drainage Study, October 1986. An analysis shall be performed by the City to determine the applicant's fair share of the improvement cost, which will be paid to the City prior to the issuance of grading permits. Lighting on the site shall comply with the West Covina Parking Lot and Lighting Design Standards to restrict the spillover of light and glare onto • adjacent properties. xx. The Norma Avenue Street frontage shall be planted with specimen size plant materials including a mixture of trees, shrubs and groundcover that will soften the visual appearance of the buildings and site lighting. A detailed landscape and irrigation plan shall be prepared pursuant to the Water Efficient Landscape and Irrigation standards of the West Covina Municipal Code and will incorporate the planting of specimen size trees (24" box, 36" box or larger) on a two to one ratio for the trees removed under Tree Removal Permit No. 21. All landscape and irrigation improvements shall be installed to the satisfaction of the City Engineer prior to the issuance of a certificate of occupancy. t. Building and Engineering Division requirements: Comply with all conditions contained in Planning Commission Resolution No. 567. ii. Sanitary sewers shall be provided to each `lot" in compliance with Municipal Code Chapter 23, Article 2, and to the satisfaction of the City Engineer. iii. The required street improvements shall include that portion of Garvey Avenue contiguous to subject property. iv. The required street dedication shall include that portion of Garvey Avenue, contiguous to the subject property. V. The access rights to Norma Avenue shall be dedicated to the City. vi. Four -foot wide meandering sidewalks with landscaping shall be constructed along Norma Avenue to match adjacent sidewalk area treatment. vii. Adequate provision shall be made for acceptance and disposal of surface drainage entering the property from adjacent areas. viii. Parking lot and driveway improvements on private propertyshall comply with Planning Commission Resolution No. 2513, Revision 6, Parking Lot Design and Lighting Standards and be constructed to the City of West Covina Standards. ix. Water service facilities shall be constructed to at least meet the requirements for fire flow established by the City's Fire Department and the requirements of the subsequent water purveyor/owner of the facilities. • X. Prior to the issuance of Building Permits, all of the following requirements shall be satisfied. a.) A final grading and drainage plan showing existing and proposed elevations ad drainage structures (and showing existing and proposed on -site and off -site improvements) shall be submitted to and approved by the Planning Department and the Building and Engineering Department, CA W INDO W SUEMPT871 RSCC.doc Resolution No. 9714 Precise Plan No. 871 Hassen Imports Partnership - West Covina Dodge July 20, 1999 - Page 9 b.) Arrangements for the installation of streetlights with underground wiring shall be made with Southern California Edison Company. At the time of installation, the applicant shall provide the necessary trenching and backfill. Submit two sets of the subdivision and/or development plan to the Building and Engineering Division, Traffic and Lighting Section, to be used for designing the street lighting system. c.) A parking lot lighting plan showing electrolier types and locations, average illumination levels, points of minimum illumination and photometric data in conformance with Planning Commission Resolution No. 2513, Revision 6, and as requested shall be submitted to and approved by the City Engineer and Planning Director d.) An itemized cost estimate for all on -site and off -site improvements to be constructed (except buildings) shall be submitted to the Engineering Department for approval. Based upon the approved cost estimates, required fees shall be paid and improvements securities for all on -site and off -site improvements (except buildings) and 100% labor/material securities for all off -site improvements, shall be posted prior to final approval of the plans. xi. A Lot Line Adjustment to combine all the lots into one lot is required prior to issuance of a Building Permit with the exception of the former West Covina Saturn parcel which will require the recordation of a lot tie covenant to hold the parcels as one. Said agreement shall be recorded and a recorded copy shall be placed on file in the Planning and Engineering Division offices prior to issuance of permits. The existing residential units shall be demolished prior to the recordation of the lot line adjustment. xii. The required Lot Line Adjustment shall conform to West Covina Municipal Code Chapter 20 — Subdivisions. xiii. Comply with all requirements of the following Codes of the City and State: a). 1994 Uniform Building Code b). 1994 Uniform Plumbing Code c). 1994 Uniform Mechanical Code d). Title 24 State of California Energy/Insulation Regulations and Handicapped persons Standards, including route of travel to and from all buildings and from sidewalk. e). 1993 National Electric Code f). West Covina Municipal -Code Chapter 7, Article X1V - Building Security is xiv. Compliance with the State of California Accessibility regulations is required, including: a). Accessible passenger loading zone shall have a 60" by 240" minimum access and unloading aisle alongside and parallel to the loading zone with curb cut access. b). Accessible path of travel to entrances from the public sidewalk. Clearly show connection to public sidewalk. Avoid vehicle paths or behind parked vehicles, see h). • c). All sidewalks and curb within any pedestrian path of travel shall be made accessible by use of curb ramps. Show and incorporate into plans. d). The slope of accessible paths shall comply with ramp and handrail requirements when exceeding 5%. Cross slope shall not exceed 2%. Slope within parking space shall not exceed 2%. Provide elevations and finish floor elevations at points to verify slopes, especially at lower level accessible parking and customer drop off. e). Doors shall open onto a clear level floor landing space at least 60" deep and extending 18" on the strike -side (24" at exterior doors). xv. An agreement to hold the Clippinger and old Saturn site properties "as - one" is required to be recorded prior to building permit issuance.. xvi. Exiting shall comply with UBC Chapter 10. Two exits from lobby, boutique, customer lounge shall not pass through S3 storage/parking occupancy. Exit path width shall be 44" clear. xvii. Commercial car washing shall only occur in approved designated areas. Clearly show all designated car wash areas. These areas shall be covered and drain to an approved oil separator and then to the sanitary sewer. xviii. Designate storage area for used oil storage. Comply with building and fire code for hazardous materials. Area shall be covered and comply with spill control and containment requirements. Floor shall drain to an approved oil separator and to the sanitary sewer. xix. The project shall comply with the intent of the clean water act. A Standard Urban Stormwater Mitigation Plan is required prior to permit issuance and shall become a condition of approval. . xx. Floors of covered S3 parking and H4 and repair garages shall drain to floor drains discharging to an approved oil separator and then to the sanitary sewer. xxi. Drainage areas not covered such as top deck and ramp, and subject to rainwater shall drain to an approved clarifier (or other approved BMP's such as landscaped swale areas) and then to the. storm drain system. xxii. Prior to issuance of building permits: a). Automatic fire sprinklers are required throughout the structure. b). Show the occupancy group of each use on the plan. Comply with UBC 302 and Table 3-C for fire rated occupancy separations. One -hour separation is required between S3, H4, M and B • occupancies. c). Separate plumbing, mechanical and electrical plan check will be required. d). A fire alarm system is required. e).
