Resolution - 9669RESOLUTION NO.9669 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, ORDERING THE ABANDONMENT OF THE SHAKESPEARE PARK SITE, DESCRIBED HEREIN, PURSUANT TO GOVERNMENT CODE . SECTION 38501 ET. SEQ. WHEREAS, Section 38501 et. seq. of the California Government Code sets forth the procedure to permit the abandonment and sale of a public park site; and WHEREAS, on February 16, 1999, the City Council adopted Resolution No. 9660, declaring its intent to abandon the Shakespeare Park site (as legally described in Exhibit A) and set April 6, 1999 as the date for the protest hearing on this matter; and WHEREAS, said Resolution No. 9660 was published in a newspaper of general circulation and posted on the site in accordance with the requirements of Government Code Section 38504; and WHEREAS, pursuant to Government Code Section 38501, the City Council hereby finds as follows: 1. Tract No. 31987 was recorded with the Los Angeles County Registrar - Recorder on August 23, 1978. 2. In conjunction with the recordation of Tract No. 31987, Lot 51 of said Tract (hereinafter referred to as "Shakespeare Park site" or "the park site"), comprising an area of 13.31 acres, was granted to the City of West Covina in fee simple for park purposes. 3. No other consideration was paid by the City for the park site. 4. Since the time of its dedication, the park site has continued to remain vacant and unimproved and has not been used by the public for park purposes. 5. No public funds have been expended to improve the park site as a park; and WHEREAS, the City Council finds that, given the facts stated above, the Shakespeare Park site meets the requirements set forth in Government Code Section 38501 to allow for the abandonment and sale of the site; and WHEREAS, on April 6, 1999, the City Council conducted a protest hearing pursuant to Government Code Section 38505 to hear and pass on objections to the proposed abandonment of the Shakespeare Park site. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of West Covina does hereby resolve as follows: SECTION NO. 1: The City Council hereby orders the abandonment of the Shakespeare Park site. • SECTION NO. 2: The City Clerk shall certify as to the passage of this resolution.
