A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, DECLARING ITS INTENT TO
ABANDON THE SHAKESPEARE PARK SITE AND SETTING
THE DATE FOR A PROTEST HEARING REGARDING THIS
• MATTER.
WHEREAS, Section 38501 et. seq. of the California Government Code sets forth
the procedure to permit the abandonment and sale of a public park site; and
WHEREAS, the Shakespeare Park site, located adjacent to the southwesterly
comer of Shakespeare Drive and Nogales Street (as legally described in Exhibit A) was
dedicated in fee to the City in 1978 for park purposes in conjunction with the recordation
of Tract No. 31987; and
WHEREAS, no other consideration was paid for the land in conjunction with its
dedication to the City; and
WHEREAS, since the time of its dedication as a park site, the subject property has
continued to remain vacant and unimproved and has not been used by the public for park
purposes; and
WHEREAS, no public funds have been expended to improve the land as a park;
and
WHEREAS, the City Council finds that, given the facts stated above, the
Shakespeare Park site meets the requirements set forth in Government Code Section
38501 to allow for the abandonment and sale of the site; and
WHEREAS, the sale of the park site will generate revenues that can be used by the
City for other purposes to benefit the welfare of the City's residents.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
West Covina does hereby resolve as follows:
SECTION NO. 1: The City Council hereby declares its intent to abandon the
park site herein described and fixes the date of April 6, 1999 to hear objections to the
proposed abandonment and to take final action.
SECTION NO. 2: Staff is hereby directed to publish and post this resolution
prior to said hearing in accordance with the requirements of Government Code Section
6063 and 38504.
SECTION NO. 3: The ,City Clerk shall certify as to the passage of this
resolution.
