Resolution - 9625RESOLUTION NO. 9625 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA ADOPTING REGULATIONS -FOR CANDI- DATES FOR ELECTIVE OFFICE PERTAINING TO CANDI- DATE STATEMENTS SUBMITTED TO THE VOTERS AT THE MARCH 2, 1999 GENERAL MUNICIPAL ELECTION WHEREAS, Section 10012 of the Elections Code of the State of California provides that the governing body of any local agency adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs of the candidate statements. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. CANDIDATE STATEMENTS — GENERAL PROVISIONS. That pursuant to Section 10012 of the Elections Code, each candidate for elective office to be voted for at the General Municipal Election of March 2, 1999 may prepare a candidate's statement on an appropriate form provided by the City Clerk. The statement may include the name, age and occupation of the candidate and a brief description of no more than 200.words of the candidate's education and qualifications expressed by the candidate himself or herself. The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. The statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. The statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 pm of the next working day after the close of the nomination period. SECTION 2. CANDIDATE STATEMENTS — SPECIFIC INSTRUCTIONS. That pursuant to Section 13307 of the Elections Code, candidate statements shall be printed in type of uniform size and darkness and with uniform spacing. To ensure no candidate receives undue advantage because of the appearance of the statement, regardless of the format of the statement submitted, all statements will be typeset in paragraph styling, using upper and lower case. See the sample on the back of the candidate statement form. Also: * No outlining, bullets, or listings. * No underlinine, bolding, italicizing, or CAPS, or combinations thereof. Any grammatical, typographical, or punctuation errors contained in the statement at the time of filing will likewise appear in the printed version in the sample ballot. The sample ballot will contain an explanatory clause that informs the reader that errors contained in the Candidate Statements are those of the candidates. SECTION 3. ADDITIONAL MATERIALS. No candidate will be permitted to include additional materials in the sample ballot package. SECTION 4. LANGUAGE TRANSLATION. The City Clerk shall have the sample ballot, including all candidate statements, translated and made available in the following •. languages, as well as English: Spanish, Chinese, and Tagalog. The cost for translating shall be home by the City. SECTION 5. SAMPLE BALLOTS. The City of West Covina utilizes an English only sample ballot, containing paragraphs in Spanish, Chinese, and Tagalog explaining that fully translated sample ballots are available upon request. In addition, the Los Angeles County Registrar's Office has compiled a list of registered voters who have requested that election materials be automatically forwarded to them in their preferred language. Resolution No. 9625 Page 2 The City Clerk's Office utilizes that list and mails the appropriate translated sample ballot to those voters as soon as the translated sample ballots are available from the election supplier. • SECTION 6. PAYMENT. The City Clerk shall estimate the total cost of typesetting and printing the candidates statements filed pursuant to the Elections Code, and require each candidate filing a statement to pay in advance his or her pro rata share as a condition of having his or her statement included in the English voter's pamphlet. The estimate is hereby set at $350. Notwithstanding Section 4 above, if a candidate wishes to also include his/her Spanish Candidate Statement in the English sample ballot, the estimate is hereby set at $350, bringing the total deposit for both to $700. Inserting the Spanish translated candidate statement in the English sample ballot is permitted by Elections Code § 13307. The City Clerk shall bill each candidate after the election for any cost in excess of the deposit or shall refund any unused portion. SECTION 7. That the City Clerk shall provide each candidate or the candidate's representative a copy of this resolution at the time nominating papers are issued. SECTION 8. That all previous resolutions establishing council policy on payment for candidates statements are repealed. Further, this resolution shall apply only to the March 2, 1999 election and shall then be repealed. SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution. PASSED, APPROVED AND ADOPTED on October 6, 1998.
