A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
• WEST COVINA APPROVING THE SECOND AMENDMENT TO
THE PROCEDURES FOR FORMATION, ELECTION AND OPERATION
OF THE PROJECT AREA COMMITTEE
FOR THE REDEVELOPMENT PLAN FOR THE PROPOSED
WEST COVINA CITYWIDE REDEVELOPMENT PROJECT AREA
WHEREAS, the Redevelopment Agency of the City, of West Covina (the "Agency")
desires to prepare and adopt a Redevelopment Plan (the "Plan") for the proposed West Covina
Citywide Redevelopment Project (the "Project"); and
WHEREAS, Health and Safety Code Section 33385 requires that the legislative body of
a city call upon residents and existing community organizations in the redevelopment project
area to form a project area committee (PAC) if a substantial number of low-income persons or
moderate -income persons, or both, reside within the project area, and the redevelopment plan as
adopted will contain authority for the agency to acquire, by eminent domain, property on which
any persons reside; and
WHEREAS, on April 21, 1998 the City Council did make findings that a Project Area
Committee was necessary to effectuate the adoption of the West Covina Citywide
Redevelopment Plan; and
WHEREAS, on April 21, 1998 the City Council of the City of West Covina (the "City
Council') adopted Procedures for Formation, Election and Operation of the Project Area
Committee for the Redevelopment Plan for the Proposed West Covina Citywide Redevelopment
Project Area (the "PAC Procedures"); and
WHEREAS, an election was held on May 28, 1998 for the members of the Project Area
Committee (the "PAC") pursuant to the PAC Procedures (the "First Election"); and
WHEREAS, on June 16, 1998 the City Council adopted a finding by resolution of the
City Council that all of the PAC Procedures were followed in the First Election, and certified the
results of the First Election; and
WHEREAS, the City Council determined after a duly noticed public hearing held on
July 7, 1998 that two additional Residential Owner Occupants need to be added to the PAC in
order for Residential Owner Occupants residing within the proposed West Covina Citywide
Redevelopment Project to be adequately represented on the PAC, and adopted the First
Amendment to the PAC Procedures to add such members, which is attached hereto as
Attachment "A"; and
WHEREAS, the City Planning Commission, with the approval of the Agency, has now
removed all residential owner -occupied dwellings from the boundaries of the proposed West
Covina Citywide Redevelopment Project, which is attached hereto as Attachment `B"; and
WHEREAS, as a result of such deletion there is no longer a need for Residential Owner
Occupants to be represented on the PAC; and
WHEREAS, the City Council desires to amend the PAC Procedures to eliminate all
Residential Owner Occupants from the PAC.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA
DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council finds there is no longer a need for Residential Owner Occupant
representatives on the PAC for proposed West Covina Citywide Redevelopment Project.
Section 2. The City Council hereby approves the Second Amendment to the Procedures for
the Formation, Election and Operation of the Project Area Committee as attached hereto as
Attachment `C".
• Section 3. The City Council hereby directs the Agency to delete all Residential Owner
Occupant representatives and operate the PAC pursuant to Health and Safety Code Sections
33385 and 33386 through 33388.
Section 4. The City Clerk shall certify to the adoption of this resolution.
