A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, ESTABLISHING
ADMINISTRATIVE FINES PURSUANT TO THE PROVISIONS
• OF ORDINANCE NO.2015.
WHEREAS, on April 21, 1998, the City Council introduced an Ordinance
establishing a procedure for imposing and collecting administrative fines for violations of
the West Covina Municipal Code; and
WHEREAS, on May 5, 1998, the City Council adopted said Ordinance as
Ordinance No. •2015; and
WHEREAS, Municipal Code Section 15-226(a) states that "the amount of
administrative fines shall be determined by resolution of the City Council, which shall
include late payment charges and increased fines for repeated violations."
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
West Covina does hereby resolve as follows:
SECTION 1. Applicability.
This Resolution, and fines established pursuant thereto, shall be applicable to
violations of the West Covina Municipal Code treated as infractions pursuant to Article
XI, Chapter 15 of the West Covina Municipal Code, for which one or more administrative
citations have been issued. These fines shall be collected from the Responsible Party as
defined in Municipal Code Section 15-223(a)(1).
SECTION 2. Fines Established.
A. Except as otherwise set forth in paragraphs A. and B. below, the fine for
violations of the West Covina Municipal Code shall be $50.00 in conjunction with the
issuance of the first administrative citation, and $100.00 in conjunction with the issuance
of all subsequent administrative citations for the same violations.
B. For violations of the sections of the West Covina Municipal Code listed
below, the fine shall be $25.00 in conjunction with the issuance of the first administrative
citation, and $50.00 in conjunction with the issuance of all subsequent administrative
citations for the same violations.
(1) Sec.7-136 Sign permit required.
(2) Sec. 12-17(c) Failure to subscribe for rubbish collection service.
(3) Sec. 12-20(d) Waste containers in view.
C, For violations of the sections of the West Covina Municipal Code listed
below, the fine shall be $100.00 in conjunction with the issuance of the first administrative
citation, and $200.00 in conjunction with the issuance of all subsequent administrative
citations for the same violations.
' (1) Sec. 15-2 Dumping on public or private property.
(2) Sec. 19-8 Permitting water to flow upon public streets.
(3) Sec. 26-231 Precise plan compliance.

SECTION 3. Multiple and Repeat Violations.
A. Multiple Violations.
1. In cases where one administrative citation has been issued for a
multiple number of violations of the Municipal Code, a single fine shall be
imposed for all of the identified violations.
2. In cases where one administrative citation has been issued for a
multiple number of violations of the Municipal Code wherein different fine
amounts have been established for such violations, the fine shall be the highest fine
amount for any of the individual violations.
B. Repeat Violations.
In the event that the same Responsible Party is cited for the same code
violation(s) at the same property location within any six (6) month period of time,
the fine(s) imposed for both the first and subsequent citations shall be doubled
from the fine(s) applicable to the original violation.
SECTION 4. Penalties for Late Payment.
Fines not paid in a timely manner pursuant to Municipal Code Section 15-226(c)
shall be assessed a late payment charge of $10.00 in conjunction with the issuance of the
first administrative citation, and $25.00 in conjunction with the issuance of all subsequent
administrative citations for the same violations.
SECTION 5. Effective Date.
This Resolution shall become operative and take effect concurrently with the
effective date of Ordinance No. 2015.
SECTION 6. The City Clerk shall certify as to the passage of this resolution.
