RESOLUTION NO. 9559
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA FINDING THAT A PROJECT AREA COMMITTEE IS
NECESSARY TO EFFECTUATE THE ADOPTION OF THE WEST
COVINA CITYWIDE REDEVELOPMENT PLAN, DIRECTING THE
FORMATION OF A PROJECT AREA COMMITTEE AND ADOPTING
GUIDELINES AND PROCEDURES FOR THE FORMATION, ELECTION
AND OPERATION OF A PROJECT AREA COMMITTEE FOR THE
CITYWIDE REDEVELOPMENT PROJECT AREA.
WHEREAS, the Redevelopment Agency of the City of West Covina (the "Agency") desires to
prepare and adopt a Redevelopment Plan (the "Plan") for the proposed West Covina Citywide
Redevelopment Project (the "Project"), and
WHEREAS, by resolution, the West Covina City Council (the "City Council") has designated a
Redevelopment Survey Area for redevelopment study purposes, and
WHEREAS, by resolution, the Planning Commission, among other actions, made
recommendation to the Agency about the boundaries of the potential redevelopment project area;
and
WHEREAS, by resolution, the Agency did accept and approve the Preliminary Plan for the
proposed West Covina Citywide Redevelopment Project, which included the boundaries of the
Project Area selected by the Planning Commission (the "Project Area"); and
WHEREAS, the California Community Redevelopment Law ("CCRL") Health and Safety Code
Section 33342 provides for the Agency to acquire by gift, purchase, lease or condemnation all or
part of the real property in the project area; and
WHEREAS, it has been determined that a substantial number of low-income persons or
moderate -income persons, or both, reside within the Project Area; and
WHEREAS, the Agency has directed that the Plan prepared for the Project authorize the Agency
to acquire real property within the Project Area for purposes of redevelopment; and
WHEREAS, Health and Safety Code Section 33385 requires that the legislative body of a city
shall call upon the residents and existing community organizations in redevelopment project area
to form a project area committee (PAC) if a substantial number of low-income persons or
moderate -income persons, or both, reside within the project area, and the redevelopment plan as
adopted will contain authority for the agency to acquire, by eminent domain, property on which
any persons reside, and
WHEREAS, Redevelopment law requires that the legislative body adopt, after a duly noticed
public hearing, communitywide procedures for filing for election, publicizing an election,
holding an election, and for reviewing disputed elections, filling vacated seats, and other matters
related to the electoral process of a Project Area Committee; and
WHEREAS, on April 21, 1997 the Agency held a duly noticed public hearing at which time the
guidelines and procedures for the formation, election, and operation of the Project Area
Committee for the proposed West Covina Citywide Redevelopment Project Area, attached hereto
as Attachment "A", were duly considered;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council finds for the reasons recited within this resolution a Project
Area Committee must be formed as a part of the Redevelopment Plan adoption process:
Section Z The City Council hereby approves the Procedures for the Formation, Election,
and Operation of the Project Area Committee for the Proposed Citywide Redevelopment Project
Area.
Section 3. The City Council directs the Agency to establish and operate the PAC pursuant to
Health and Safety Code Sections 33385, and 33386 through 33388.
Section 4. The City Clerk shall certify to the adoption of this resolution.
