Resolution - 9513RESOLUTION NO. 9513 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING CERTAIN PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION OF THE PUENTE AVENUE DRAIN PROJECT IN THE CITY OF WEST COVINA, CALIFORNIA, AND AUTHORIZING THE USE OF PUBLIC STREETS FOR CONSTRUCTION, OPERATION, AND MAINTENANCE OF THESE FACILITIES. The City Council of the City of West Covina does resolve as follows: SECTION 1. That those certain plans and specifications entitled "Specifications for Construction of Puente Avenue Drain, in the City of West Covina, the County of Los Angeles, State of California," by this reference herein incorporated, be and the same are hereby adopted and approved, and the Los Angeles County Department of Public Works is hereby authorized to proceed the construction therein described. Permission is granted hereby to use and occupy the public streets of the City of West Covina to construct, operate, and maintain the installations as and to the extent set forth in said specifications. The City Building and Engineering Department is hereby authorized and empowered to issue to said Department of Public Works and necessary no charge permits for construction of said drains according to said specifications. SECTION 2. The City of Covina, where legally possible and upon the request by the County of Los Angeles, will grant, transfer, or assign all prior rights over utility companies when necessary to construct and complete this project. SECTION 3. The Los Angeles County Department of Public Works shall not be held accountable for the expense of relocation, alteration, or modification of this project, once installed, necessitated by future street improvements, realignments, alteration, or reconstruction. SECTION 4. The City Clerk shall certify to the adoption of this resolution. Box 1440 West Covina, CA 91793-1440 Attention Mr. Nareesh Palkhiwala Dear Mr. Glover: PUENTE AVENUE DRAIN Enclosed are two sets of final plans and specifications for our proposed Puente Avenue Drain project., This project is considered categorically exempt in accordance with the Los Angeles County Environmental Reporting Procedures and Guidelines. It is requested that your City Council formally approve the plans and specifications; authorize this Department to proceed with the construction of the project as described herein; grant permission. to occupy and use the public streets in the City of West Covina to construct, operate; and maintain said installations; and issue the needed Excavation Permit on a no -fee basis. Your City Council's action should contain the following statements: "The City of West' Covina, where legally possible and upon the request by the County of Los Angeles, will grant, transfer, or assign all prior 'rights over utility companies when necessary to construct and complete this project." In addition, "The County of Los Angeles shall not be held.accountable for the expense of relocation, alteration, and modification of this project, once installed, necessitatedby future street improvements, realignments, alteration, or reconstruction." The Department of Public Works is administering all contracts for the Los Angeles County Flood Control District under the provisions of its Flood Control Act. The Act requires that this approval be obtained before the construction contract shall be awarded. Mr. Patrick Glover October 29, .1997 Page 2 Also, as discussed with Mr. Sam Ito of our City Services Section, the plans and specifications have been revised .to include slurry sealing the City's streets along the project alignment. It is our understanding that the necessary purchase order for this work will be authorized by your City. A list of locations and an estimated cost is enclosed for your information. Your City Council's approval on the above item would be appreciated by November 18, 1997: At that time, please forward a certified copy of your Council's action to this Department.
