Resolution - 9492RESOLUTION NO. 9492 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING RESOLUTION NO. 7223, RELATING TO COMPENSATION AND CLASSIFICATION OF POSITIONS AS AMENDED, AND FIXING COMPENSATION AND BENEFITS FOR CLASSES REPRESENTED BY THE WEST COVINA FIREFIGHTERS' ASSOCIATION, I.A.F.F, LOCAL 3226. WHEREAS, the City of West Covina has met and conferred with the West Covina Firefighters' Association (hereinafter Firefighters' Association) on fifteen separate occasions to discuss matters concerning salary, benefits, and terms and conditions of employment; and WHEREAS, the City and Firefighters' Association have met their obligation to meet and confer in good faith in an effort to reach agreement; and WHEREAS, such discussions have failed to result in an agreement between the parties; and WHEREAS, the Firefighters' Association has submitted a declaration of impasse in such discussions; and WHEREAS, the City Council has considered such written and verbal submissions by the parties as are pertinent to arriving at a course of action and have made a determination to implement the City's last best offer; and WHEREAS, discussions between the parties have resulted in agreement only on the salary and benefits for the classification of Fire Marshal as a separate bargaining unit; NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION 1. Salary. Effective June 28, 1997, the City shall provide a one and one-half percent (1-1/21/o) salary increase for employees in the classifications of Firefighter, Firefighter/Paramedic, Engineer and Captain. Effective June 28, 1997, the City shall provide a one and seven -tenths percent (1.7%) salary increase for the classification of Fire Marshal. SECTION 2. Retiree Medical. As soon as administratively practical, an eighty dollar ($80) per month increase to offset retiree medical premiums, through the Public Employees' Retirement System (PERS) shall be implemented. SECTION 3. Uniform Allowance. Effective as soon as administratively practical for disbursement, an increase in uniform allowance of $50 shall be made. SECTION 4. Manning Policy. The language in the existing Memorandum of Understanding (MOU) is amended to allow for manning of the Paramedic Engine Program should it be implemented. Such manning would provide for: (1) Four -man engine companies: one Captain, one Engineer, two Firefighter/Paramedics; (2) Three-man truck companies: one Captain, one Engineer, one Firefighter; and (3) Two -man Paramedic rescues would remain in place only until such a time as the Paramedic Engine Companies have been implemented. SECTION 5. Sick Leave Provisions. Three additional subsections as follows: "Sick Leave Notification - Employees shall make notification to the appropriate on duty Captain between 1700 hours and 0700 hours prior to a scheduled shift day. Sick leave call in before 1700 wmdm ae.doc 1 hours on a day prior to a member's scheduled work day must be made by the employee by telephone to the on -duty Battalion Chief."; "Physician Documentation - Proof of medical treatment may be required after absence due to illness or injury for periods extending two consecutive shifts or more. If documentation is to be required it will be requested before or during the time of the second normal shift day that the employee would have been working. If absence has been due to an off duty injury that prohibits return to full duty, the City reserves the right to require an evaluation by the City's occupational physicians at City expense."; "Sick Leave Recuperation -Sick leave is provided for the purpose of recuperating from illness or injury. Participation in other work or recreational activities is not considered appropriate use of sick leave time. Employees may be contacted at any time while on sick leave to secure an update on health status unless on extended sick leave or where regular contact is deemed impractical or unnecessary due to physician documentation." SECTION 6. Where provisions of the MOU are inconsistent with existing Personnel Rules, the approved changes and current MOU provisions shall prevail. Other existing provisions in the 1996/97 MOU shall continue for the period of Fiscal Year 1997/98. SECTION 7. Budget Allocation. The City Council does hereby appropriate an amount of money sufficient to fund the salary and benefit changes provided by this Resolution. SECTION 8. The remaining provisions of Resolution No. 7223, as amended, shall remain in full force and effect until repealed by Resolution of the City Council. SECTION 9. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 23rd day of September, 1997.
