Resolution - 9473RESOLUTION NO. 9473 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA APPROVING A CONTRACT FOR THE INSTALLATION OF FREEWAY IMPROVEMENTS AND APPROVING THE FUNDING OF FREEWAY IMPROVEMENTS BY THE REDEVELOPMENT AGENCY OF • THE CITY OF WEST COVINA AND MAKING CERTAIN FINDINGS THEREWITH WHEREAS, Section 33445 of the California Community Redevelopment Law authorizes a redevelopment agency, with the consent of the legislative body, to pay all or part of the value of the land for and the cost of the installation and construction of any building, facility, structure, or other improvement which is publicly owned either within or without the project area upon certain findings; and WHEREAS, the Redevelopment Agency of the City of West Covina (the "Agency") proposes to fund a portion of the cost of the installation of certain improvements to the westbound side of Interstate 10 at the Citrus Avenue offramp, generally consisting of landscaping and an automatic irrigation system (the "Public Improvements"); and WHEREAS, the City of West Covina (the "City") has entered into a "Maintenance Agreement" with the State of California, acting by and through the Department of Transportation ("CalTrans"), which provides for the installation and continued maintenance of the Public Improvements; and WHEREAS, the City Council has approved the design of the Public Improvements and has solicited bids for the installation of the Public Improvements in accordance with applicable law; and WHEREAS, the lowest responsible bid submitted for the installation of the public improvements was for the amount of $29,996, which bid was submitted by Mariposa Horticultural; and WHEREAS, the City's approval of the Maintenance Agreement was made contingent upon the approval by the Agency of all costs for installation of the Public Improvements per approved plans and specifications and a binding agreement from West Covina Lincoln Mercury to pay for the costs of maintaining the Public Improvements for two years; and WHEREAS, CalTrans has represented to the City and the Agency that it is unable to pay for the installation of the Public Improvements; and WHEREAS, the operator of the West Covina Lincoln Mercury automobile dealership, which is located adjacent to the proposed Public Improvements, has offered to pay for a portion of the cost of the installation and maintenance of the Public Improvements; and WHEREAS, the Agency proposes to pay approximately $12,500 for a portion of the cost of the installation of the Public Improvements; and WHEREAS, the Agency's financing of a portion of the cost of the Public Improvements will assist in the alleviation of blight in the Project by removing the existing freeway landscaping, which has become overgrown and has created a "fortress" effect, hindering visibility and causing obstruction of businesses within the Project; and WHEREAS, the expenditure of Agency funds for the proposed Public Improvements is of benefit to the West Covina Redevelopment Project (the "Project") by alleviating a blighting • condition within the Project and facilitating the visibility of businesses within the Project from Interstate 10; and WHEREAS, there are no other reasonable means of financing the cost of the Public Improvements available to the community, as the City has no additional funds available to pay for such costs without obtaining those payments from the City's reserve funds, which would cause the City's reserves to be maintained at less than a fiscally prudent level, CalTrans has represented that it is unable to pay for such costs, and the West Covina Lincoln Mercury Dealership has represented that it is unable to pay a greater share of the cost than it has offered to pay; and WHEREAS, the Redevelopment Plan for the Project provides for the Agency to pay all or part of the cost of the installation of publicly owned improvements inside or outside of the Project, including the construction or reconstruction of streets throughout the Project, and streetscape improvements in the Central Business District portion of the Project; and WHEREAS, the Implementation Plan for the Redevelopment Project, which was adopted by the Agency in 1994 pursuant to Health and Safety Code Section 33490, identifies the following • objectives of the Agency in carrying out the Redevelopment Plan: encouragement of private sector investment if the Project, promotion of the economic well being of the area by encouraging diversification of its commercial base, promotion of diverse local job opportunities, elimination and prevention of the spread of blight, and providing opportunities for commercial and industrial firms to locate their operations in an attractive, safe and economically sound environment; and Cl WHEREAS, the Public Improvements would satisfy the above objectives of the Implementation Plan by removing a blighting condition, generating private investment in the Project by West Covina Lincoln Mercury, and assisting in the renovation, new development and retention of stable businesses within the Project. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES RESOLVE AS FOLLOWS: Section 1. The City Council hereby approves the bid of $29,996 by Mariposa Horticultural for the installation of the public improvements. The City Manager is hereby authorized to execute on behalf of the City a contract with Mariposa Horticultural for the installation of the public improvements, and to take all actions and sign all documents necessary or appropriate to carry out such contract. Section 2. The City Council finds and determines that Agency's payment of a portion of the costs of the Public Improvements is of benefit to the Project and the surrounding development, and is necessary to effectuate the purposes of the Redevelopment Plan. Section 3. The City Council finds and determines that no other reasonable means of financing the Agency's payment of a portion of the costs of the Public Improvements are available to the community. Section 4. The City Council finds and determines that the Public Improvements will assist in the alleviation of blighting conditions within the Project. Section 5. The City Council finds and determines that the Public Improvements are consistent with the Implementation Plan which has been adopted by the Agency pursuant to Health and Safety Code Section 33490. Section 6. The City Council hereby approves the Agency's expenditure of up to $12,500 for the payment of a portion of the cost of the installation of the Public Improvements pursuant to the contract between the City and Mariposa Horticultural; provided, however, that the Agency's funds shall not be used to fund the portion of such contract which pertains to the maintenance of the Public Improvements. Section 7. The City Clerk shall certify to the adoption of this resolution. PASSED, ADOPTED, AND APPROVED by the City Council of the City of West Covina at a regular meeting held on the 15th day of July, 1997.
