Resolution - 9453RESOLUTION NO. 9453 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA APPROVING A PLANNING COMMISSION • AUTHORIZED PLANNING DIRECTOR'S MODIFICATION TO PRECISE PLAN NO. 762, REVISION 1 (Upholding the decision of the Planning Commission and Planning Director). WHEREAS, the Planning Commission approved Precise Plan No. 762 on September 15, 1982, and Precise Plan 762, Revision 1 on April 17, 1985 allowing for the development of the existing automobile dealership; and WHEREAS, the subject property is located within the "Service Commercial (S-C)" zone on that property generally described as the follows: Los Angeles County Assessor's Parcel Number 8478-004-041,906; and WHEREAS, the Planning Commission, at a duly authorized public hearing on March 22, 1997, authorized the Planning Director to approve a Planning Director's Modification (PDMOD) to Precise Plan No. 762, Revision 1 after considering the proposed modifications to the project; and WHEREAS, the Planning Director approved the Planning Director's Modification on April 22, 1997; and WHEREAS, Hassen Imports Partnership filed an appeal to the City Council of the Planning Director's April 22, 1997 action; and WHEREAS, this appeal has been noticed as required by the West Covina Municipal Code (WCMC) and other laws for modification of a precise plan; and WHEREAS, studies and investigations made by this Commission and in its behalf reveal the following facts: 1. The applicant is proposing to modify the exterior building elevations by adding a new facial material, and repainting the building and storefront without changing the massing or proportions of the building, and modify the on -site circulation by changing the number and location of driveways (from private street) accessing the site and reconfiguring on -site customer parking, landscaping, and display area accordingly. 2. The proposed changes are consistent with the remodel of the adjacent, currently occupied Mercedes-Benz Dealership, represent the corporate image of Penske Motorcars and are compatible with the level of architectural design detail within the West Covina Auto Plaza. 3. The driveway revisions are minor modifications to the circulation patterns and will not adversely impact traffic flow on and surrounding the site. • 4. The project, as revised, continues to meet or exceed the development standards of the S-C zone. 5. The project, as designed, complies with the Garvey Auto Center Development Guidelines. ZACC \RESOSBD\pnskaplrs Resolution 9453 Appeal Penske PDMOD to PP No. 762, Rev. 1 May 20, 1997 - Page 2 NOW THEREFORE, the City Council finds and resolves as follows: a. the PDMOD does not adversely affect the public interest as the . modification consists of a minor change to a precise plan which will not be detrimental to adjacent properties. The proposed modification to the building elevations do not affect the scale of the development nor result in a reduction in building setbacks that might otherwise affect adjacent properties. The modification to the on -site circulation better defines the path of travel for customers accessing the site and results in a reduction in potential turning movements within the private street area; and b. the PDMOD does not adversely affect the interests of neighboring property owners as it is a minor conforming change to the precise plan which the Planning Commission has already approved. The proposed building remodel and on -site circulation modifications are generally consistent with the previously approved plan and result in an enhancement of the building as well as a more efficient circulation pattern without conflicting with the adjacent automobile dealerships; and C. the PDMOD does not alter any plan for use of the property in any manner not previously approved by the Planning Commission as the use of the facility is not proposed to change and the proposed modification is within the scope of the previously approved plans; and d. the PDMOD does not affect any other conditions of approval than those set out. 1. The Planning Director acted within the authority granted to him by the Planning Commission at the duly advertised public hearing held on April 22, 1997 in that the Planning Director's Modification to Precise Plan No. 762, Revision 1 did not authorize any other project changes beyond those considered in the public hearing. 2. That the approval of the precise plan modification is subject to the following conditions: a. Comply with Study Plan "A", dated April 22, 1997. b. Comply with Exhibits 1-3, dated April 22, 1997 C. Obtain approval of building permits for the modification in project design prior to commencing work. d. Prior to the issuance of building permits, the applicant shall submit three copies of detailed landscaping and irrigation plans to the • Planning Department for review and approval. Said plan shall include type, size, and quantity of landscaping materials, as well as, a fully automatic comprehensive watering system in compliance with the City's water efficient landscape requirements. Landscaping areas are to be kept free of litter and diseased, damaged or dead plants. Diseased, dead, damaged and/or disfigured plants shall be replaced as deemed necessary by the Planning Director. All installation of landscaping and irrigation shall be completed prior to issuance of a Certificate of Occupancy or final Building and Engineering Department clearance. Prior to the issuance of a permit for exterior improvements, a final grading and drainage plan for the affected modified areas showing existing and proposed elevations and drainage structures (and • showing existing and proposed on -site and off -site improvements) shall be submitted to and approved by the City Engineer and Planning Director. 11 An itemized cost estimate for all on -site and off -site improvements to be constructed (except buildings) shall be submitted to the Engineering Department for approval. Based upon the approved cost estimates, required fees shall be paid and improvements securities for all on -site and off -site improvements (except buildings) and 100% labor/material securities for all off -site improvements, shall be posted prior to final approval of the plans. f. Comply with the requirements of the following codes of the city, state and nation: i. 1994 Uniform Building Code ii. 1994 Uniform Plumbing Code iii. 1994 Uniform Mechanical Code iv. 1993 National Electric Code V. Title 24 State of California Energy/Insulation Regulations and Handicapped Persons Standards vi. Uniform Fire Code 3. That the City Clerk shall certify to the adoption of this resolution. 4. This action by the City Council is final. The appellant may challenge it in a court action filed within the time frames allowed by law ADOPTED AND APPROVED this 20`h day of May, 1997.
