RESOLUTION NO. 9434
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA,
ESTABLISHING A FEE FOR PROCESSING
APPLICATIONS FOR ADMINISTRATIVE USE
PERMITS
WHEREAS, on April 1, 1997, the City Council adopted Ordinance No. 1992
amending certain sections of Chapter 26 (Zoning) of the West Covina Municipal
Code, to develop provisions for an administrative use permit procedure (Code
Amendment No. 277); and
WHEREAS, said Ordinance established a new type of administrative permit "
referred to as an "administrative use permit," for the purpose of consolidating several
of the existing administrative permits into one uniform procedure; and
WHEREAS, the creation of the administrative use permit now necessitates the
establishment of an associated fee to recover the cost of reviewing and processing
applications for administrative use permits; and
WHEREAS, pursuant to Government Code Section 66018, the City may adopt
a new fee only upon the holding of a public hearing as part of a regularly scheduled
meeting, at which time oral and written presentation can be made; and
WHEREAS, notice of the public hearing and the provision of data available to
the public was made pursuant to the requirements of Government Code Sections
66016 and 6062(a), and the required public hearing was held on April 15, 1997; and
WHEREAS, the fees and charges adopted are for operating expenses and not
capital charges; and
WHEREAS, pursuant to Government Code Section 66016(a), a new fee
established by the City may not exceed the estimated amount required to provide the
service for which the fee is established; and
WHEREAS, the adoption of a new fee for operating expenses is statutorily
exempt from environmental review under the California Environmental Quality Act
(Section 15273, CEQA Guidelines).
NOW, THEREFORE, the City Council of the City of West Covina does
resolve, determine, and order as follows:
Section 1. Fee. The fee for an administrative use permit, with the
exception of an administrative use permit for a miniature pot-bellied pig, is hereby
established as: $75 filing fee per application plus $58 per hour of staff time spent to
review and process the application. The fee for an administrative use permit for a
miniature pot-bellied pig shall be $50.
. Section 2. Reasonable Cost Finding. With the exception of applications for
miniature pot-bellied pigs, the above fee is based on the actual staff time spent to
review and process an administrative use permit application and the estimated cost
of supplying staff services. The City Council therefore finds that the adopted fee
does not exceed the reasonable cost of the service provided. The fee for miniature
pot-bellied pigs will be less than the actual cost to review and process the
applications.

Section 3. Severability. If any portion of this resolution is found to be
unconstitutional or invalid, the City Council hereby declares that it would have
enacted the remainder of this Chapter regardless of the absence of any such invalid
• part.
