RESOLUTION NO. 9412
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, CONFIRMING THE
COST REPORT TO ABATE THE DECLARED PUBLIC
NUISANCE LOCATED AT 1235 SOUTH MULLENDER
AVENUE.
WHEREAS, the City of West Covina has adopted an Administrative Nuisance
Abatement Ordinance (WCMC Sec. 15-200) which identifies conditions which
constitute a public nuisance; and
WHEREAS, unprotected and/or hazardous pools are a condition which
constitute the declaration of a public nuisance; and
WHEREAS, the property located at 1235 South Mullender Avenue has been
determined by the Planning Director to be an immediate threat to life and public health;
and
WHEREAS, an inspection and abatement warrant was issued by Citrus
Municipal Court to abate the public nuisance; and
WHEREAS, the City Council has declared the property at 1235 South Mullender
Avenue a public nuisance; and
WHEREAS, the City has billed the property owner for costs of abatement; and
WHEREAS, the property owner has not submitted payment for the cost of
abatement; and
WHEREAS, said property was posted and notice sent to the property owner on
February 4, 1997, pursuant to Section 15-211 of the West Covina Municipal Code,
notifying the property owner of the cost report hearing to be conducted by the City
Council on February 18, 1997.
NOW THEREFORE, the City Council of the City of West Covina, California,
does hereby resolve as follows:
Section No. 1: - Based upon the evidence presented, the City Council
confirms the cost report (attached hereto and incorporated in reference) to abate the
nuisance at 1235 South Mullender Avenue.
Section No. 2: The cost of abatement must be paid in full within sixty (60)
days of adoption of this resolution. If payment is not received, the City Council
authorizes transmittal to the County Recorder, Assessor and Tax Collector as provided
in Section No. 26-213.
Section No. 3: The City Clerk shall certify to the passage of this resolution.
