Resolution - 9405RESOLUTION NO. 1405 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, VACATING AND ABANDONING A ' PORTION OF A STREET WHICH IS EXCESS RIGHT-OF-WAY (VANDERHOOF DRIVE). WHEREAS, the.portion of Vanderhoof Drive northerly of the improved cul-de-sac construction per Tract No. 45098 has been unimproved since 1988 and not used for street and highway purposes, said portion hereafter described, and WHEREAS, the above portion of Vanderhoof Drive is not intended to be used for street and highway purposes; NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION 1. Pursuant to Sections 8330 to 8340, inclusive, of the Streets and Highways Code, the City Council of the City of West Covina hereby finds and determines that the portion of Vanderhoof Drive as described below is excess right-of- way. THE EASTERLY 27.00 FEET, MEASURED AT RIGHT ANGLES, OF THOSE PORTIONS OF LOTS 93 AND 94 OF TRACT NO. 930 IN THE CITY OF WEST COVINA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 17, AT PAGES 38 AND 39 OF MAPS, ON FILE IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, DESCRIBED AS A WHOLE AS FOLLOWS: BEGINNING AT THE WESTERLY TERMINUS OF THAT CERTAIN COURSE, IN THE NORTHERLY LINE OF VANDERHOOF DRIVE, AS SHOWN AS "NORTH 890 18' 42" WEST 139.15 FEET" ON MAP OF TRACT NO. 12292, RECORDED IN BOOK 228, PAGE 1 OF MAPS, RECORDS OF SAID COUNTY; THENCE, ALONG SAID NORTHERLY LINE SOUTH 880 56' EAST 139.15 FEET TO THE EASTERLY TERMINUS OF SAID COURSE BEING THE BEGINNING OF A TANGENT CURVE CONCAVE TO THE NORTHWEST HAVING A RADIUS OF 150 FEET AND A CENTRAL ANGLE OF 720 52' 30"; THENCE, NORTHEASTERLY ALONG SAID CURVE 190.79 FEET TO THE END THEREOF; THENCE, NORTH 180 11' 30" EAST TANGENT TO SAID CURVE 364.32 FEET TO THE EASTERLY PROLONGATION OF THE NORTHERLY LINE OF LOT 14 OF SAID TRACT NO. 12292; THENCE, NORTH 880 56' WEST ALONG SAID PROLONGATION 389.24 FEET TO THE NORTHEASTERLY CORNER OF SAID LOT 14; THENCE SOUTH 10 08' WEST ALONG THE EASTERLY LINE OF SAID TRACT NO. 12292 A DISTANCE OF 454 FEET TO THE POINT OF BEGINNING. EXCEPT THE NORTHERLY 174 FEET OF SAID LAND, MEASURED ALONG THE WEST LINE OF SAID LAND. ALSO, EXCEPT THAT PORTION OF SAID LAND LYING SOUTHERLY OF THE FOLLOWING DESCRIBED LINE: c:\msoffice\winword\agenda\vanderho.doc BEGINNING AT A POINT ON THE WEST LINE OF THE ABOVE DESCRIBED LAND, DISTANT THEREON NORTH 10 08' EAST 190 FEET FROM THE SOUTHWEST CORNER OF SAID LAND; THENCE, PARALLEL WITH THE NORTH LINE OF SAID VANDERHOOF DRIVE, AND ITS EASTERLY PROLONGATION, SOUTH 880 56' EAST TO THE EASTERLY LINE OF THE ' ABOVE DESCRIBED LAND, ALSO, EXCEPT THAT PORTION OF SAID LAND LYING SOUTHEASTERLY OF THE FOLLOWING DESCRIBED LINE: BEGINNING AT THE MOST NORTHERLY CORNER OF TRACT NO. 45098, PER MAP RECORDED IN BOOK 1114 PAGES 68, 69 AND 70 OF OFFICIAL RECORDS OF SAID COUNTY; THENCE SOUTHERLY, ALONG THE WESTERLY BOUNDARY OF SAID TRACT NO. 45098, SHOWN AS "NORTH 170-44'-17" EAST 151.60 FEET", TO A POINT ON A NON -TANGENT CURVE CONCAVE SOUTHERLY AND HAVING A RADIUS OF 50.00 FEET, A RADIAL LINE TO SAID POINT BEARS NORTH 90 -38' -56" WEST; THENCE SOUTHWESTERLY, ALONG SAID CURVE, THROUGH A CENTRAL ANGLE OF 620-36'-47" AN ARC LENGTH OF 54.64' TO THE WESTERLY LINE OF THE ABOVE DESCRIBED 27.00 FOOT STRIP OF LAND. RESERVING AND EXPECTING ALSO from said vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers, and appurtenant structures thereof and to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and traffic control purposes and for transportation control or distribution of electric energy and water lines, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards, in, upon, and over the street or part thereof proposed to be vacated. SECTION 2. That portion of Vanderhoof Drive described in Section 1 hereof is hereby summarily vacated and abandoned. SECTION 3. The City Clerk shall certify to the adoption of this resolution and shall cause a certified copy thereof to be recorded in the office of the County Recorder of said County.
