Resolution - 9332RESOLUTION NO. 9332 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING THE PROPERTY LOCATED AT 219 NORTH MAPLEWOOD AVENUE A PUBLIC NUISANCE. WHEREAS, the City of West Covina has adopted an Administrative Nuisance Abatement Ordinance (WCMC Sec. 15-200) which identifies conditions which constitute a public nuisance; and WHEREAS, unprotected and/or hazardous pools are a condition which constitute the declaration of a public nuisance; and WHEREAS, the property located at 219 North Maplewood Avenue has been determined by the Planning Director to be an immediate threat to life and public health; and WHEREAS, said property was posted and notice sent to the property owner on May 15, 1996, pursuant to Section 15-204 of the West Covina Municipal Code, notifying the property owner of the condition of the property and the limited steps necessary to protect life, property and public health; and WHEREAS, said notices also provided the property owner with notification of a public nuisance abatement hearing to be conducted by the City Council on June 4, 1996. NOW THEREFORE, the City Council of the City of West Covina, California, does hereby resolve as follows: Section No. 1: Based upon the evidence presented, the City Council hereby finds and affirms that the subject property located at 219 North Maplewood presented an immediate threat to life and public health and declares it a public nuisance. Section No. 2: The condition of the property, specifically the contaminated pool water and insufficient pool fencing warranted pumping of the pool in order to protect life and public health. Section No. 3: The City Clerk shall certify to the passage of this resolution.
