A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, COUNTY OF LOS
ANGELES, STATE OF CALIFORNIA, REQUESTING ENACTMENT OF LEGISLATION ALLOWING FOR
THE DEATH PENALTY OF MINORS CONVICTED OF CRIMES, SUBJECT TO CAPITAL PUNISHMENT
WHEREAS, Glendora Police Officer Louis Pompei was murdered attempting to stop an armed robbery
mg committed by two minors, ages sixteen and seventeen; and
WHEREAS, these two minors would be subject to the death penalty but for current State law found in Penal
Code Section 190.5; and
WHEREAS, the punishment for murder is different between adult offenders and offerders under the age
of eighteen: and.
WHEREAS, the Juvenile Justice System has not been reviewed or major changes incorporated since
1964; and,
WHEREAS, the voters of the State of California have approved of capital punishment for certain types of
heinous crimes; and,
WHEREAS, the imposition of the death penalty has little if any deterrent effect because execution of those
so sentenced rarely occurs and is too far removed in time from the criminal act.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST COVINA
AS FOLLOWS:
Section 1. Minors, fifteen years of age and over should be subject to the death penalty if convicted of a
crime subject to capital punishment.
Section 2. The Juvenile Justice System reform by the State of California should be undertaken immediately
to create timely and appropriate consequences for juvenile offenders at all levels.
Section 3. The death penalty, once imposed by a court upon any person, adult or juvenile should be carried
out after a uniform appeals process within a prescribed statutory time frame.
BE IT FURTHER RESOLVED that a copy of this resolution shall be forwarded to West Covina's state and
federal representatives, and others as deemed appropriate.
The Mayor shall sign this resolution and the City Clerk shall certify to the passage and adoption of this
resolution and the same shall take effect and be in force.
