Resolution - 9274RESOLUTION NO. 9274 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING SUBSECTION (dd) OF RESOLUTION NO. 6130; AND AMENDING SECTION 2 OF RESOLUTION 5098, AS AMENDED; AND AMENDING SECTION E OF RESOLUTION NO. 6482. WHEREAS, the City of West Covina has had the Sick Leave Incentive and Vacation Pay Back Programs in place for employees and now. wishes to modify such programs; and WHEREAS, the Programs will continue for specified groups of employees; and WHEREAS, the City has concerns regarding the ongoing economic challenges affecting the City; and WHEREAS, the modifications of the Programs neither reduce the total amount of employee's sick leave and vacation time nor inhibit an employee's ability to use all accumulated sick leave and vacation time; and WHEREAS, the City of West Covina is not presently bound by the terms of a collective bargaining agreement for those employees impacted by the Program modifications; and WHEREAS, the City of West Covina has retained the discretion to allow an employee to exchange accumulated vacation time for cash payments only if the funds are available and the department head gives approval; and WHEREAS, the Sick Leave Program has been referred to as a pilot program subject to review; and WHEREAS, City employees retain all rights to accumulated sick leave and vacation leave upon termination pursuant to collective bargaining agreements and the City's Personnel Rules; and WHEREAS, the City has reevaluated the Sick Leave Program as the Program pertains to non -represented management employees; NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION 1. That Section 13. Sick Leave of Resolution No. 1277, as amended by Resolution No. 6130, subsection (dd), Sick Leave. Annual Payoff and Accrual, is hereby amended as follows: Sick Leave will be earned at the rate of eight hours per month for a possible total of 96 hours per calendar year. Sick leave used during each calendar year will be charged against the current year's earnings. By November 30 of each calendar year, the City will determine the amount of unused sick leave for each regular employee. Each employee must carry over to a sick leave "bank" a minimum of 56 hours in December, and may request cash payment for any hours over 56 or may add it to their sick leave bank. If 56 hours of unused sick leave are not available, the number of unused hours must be carried over to the sick leave bank. Sick leave accrued after November 30, 1995 will not be available for conversion to cash for miscellaneous Management employees who are not designated as having Public Safety status. The current payoff programs at termination or retirement, as detailed in these rules, remain unchanged. sio w.m M 11-1495 40 SECTION 2. That Section 2 of Resolution No. 5098, as amended by Section E of Resolution No. 6482, Vacation Pay Back, is hereby amended as follows: Management employees in the classifications of Police Commander, Police Lieutenant, Police Chief, Battalion Chief and Fire Chief may receive payment in lieu of up to ten days of accumulated vacation time in any calendar year upon filing a request with the Payroll Department five days prior to the requested date of issuance of the check. Cash payment for accumulated vacation time requires department head approval and is contingent upon the financial resources of the City. Employees in the classes specifically named with five or more years of City service may receive payment in lieu of up to fifteen days accumulated vacation time in any calendar year upon filing a written request with the Payroll Department five days prior to the requested date of issuance of the check. That The remaining provisions of Resolutions Nos. 6482, 6130, and 5098, as amended, shall remain in full force and effect until amended or repealed by resolution of the City Council. SECTION 4.
