Resolution - 9210f RESOLUTION NO. 9210 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALLING ON THE STATE LEGISLATURE TO AMEND THE CALIFORNIA PENAL CODE RELATIVE TO THE NOTIFICATION . OF LOCAL OFFICIALS OF THE RELEASE OF PERSONS CONVICTED OF VIOLENT FELONIES WHEREAS, the California Penal Code does not allow for proper notification and dissemination of information on convicted violent felons when they are released into society; and WHEREAS, the release of violent felons back into society without proper notification to the community is a jeopardy to public safety; and WHEREAS, the California State Legislature has the authority to amend the California Penal Code relative to notification to local jurisdictions and dissemination of same to the general public. THEREFORE, BE IT RESOLVED, by the City Council of the City of West Covina as follows: Section 1. The City Council hereby calls upon the Governor of the State of California and the Legislature of the State of California to take immediate steps to amend the California Penal Code by adding Section 3058.7 as follows: §3058.7. Notification of local officials of pending release -of persons convicted of violent felonies. (a) Whenever any sheriff or chief of police is notified of the pending release of a convicted violent felon pursuant to Section 3058.6 of the Penal Code, said sheriff or chief of police shall notify the local municipal or county elected representatives having jurisdiction over the community in which the person is scheduled to be released on parole or rereleased following a period of confinement pursuant to a parole revocation without a new commitment. The notification shall be made in a manner or method as determined by local municipal or county board or council. (b) Those elected bodies receiving the notice referred to in this subdivision and §3058.6 may disseminate such information to the general public in a manner and method as determined by the local municipal or county board or council. (c) Information released pursuant to subdivision (b) of this section may include a photograph of the person, a name, age and description of the crimes for which the person was convicted. Section 2. The City Council hereby urges all local agencies to take appropriate action to notify their State legislative representatives and the Governor that they are in support of a California Penal Code amendment relative to notification to local • jurisdictions and dissemination of same to the general public. Section 3. The City Clerk is authorized and directed to transmit a copy of this resolution to the Governor of California, our local State representatives, the clerk of the Board of Supervisors, the League of California Cities, and cities in the San Gabriel Valley.
