A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST COVINA, CALIFORNIA, GRANTING
TWO YEARS ADDITIONAL RETIREMENT SERVICE
CREDIT FOR SPECIFIED CLASSIFICATIONS OF EMPLOYEES
WHEREAS, the City of West Covina is a contracting Public Agency of the Public Employees' Retirement
System; and
WHEREAS, California Government Code Section 20821.6 provides that when the governing body of a
contracting agency determines that because of an impending curtailment of, or change in the manner of
performing service, the best interests of the agency would be served by encouraging the retirement of
local members, the governing body may adopt a resolution to grant eligible employees one to four
years additional service credit when certain conditions specified in said section exist; and
WHEREAS, said Section requires the governing body to specify the number of whole years of additional
service credit being granted and to determine a period in which eligible members, who meet the
conditions, must retire to be entitled to receive said credit; and
WHEREAS, said period may begin as early as one day following, and end not more than 120 days following,
the governing body's adoption of the resolution; and
WHEREAS, said Section requires the governing body to designate the categories of eligible members and
allows for eligibility to be limited to members employed in specific Department(s), Program(s), and/or
position classifications within said Agency;
NOW, THEREFORE, BE IT RESOLVED, that the City Council, as the governing body of the City of West
Covina has determined that because of an impending curtailment of service, or change in the manner of
performing service, the best interests of the Public Agency would be served by encouraging retirement
of local members and desires to provide two(2) years of additional service credit pursuant to Section
20821.6 for eligible local miscellaneous members. Eligible employees are limited to the Maintenance
Department and those employees involved in park, tree, street, water, graffiti removal and equipment
maintenance programs. Specifically, employees in the classifications of Maintenance Worker II,
Senior Maintenance Worker, Maintenance Leadworker, Equipment Operator, Equipment Mechanic II
and Building Maintenance Leadworker.
BE IT FURTHER RESOLVED, that said governing body determines that the period in which eligible
members, who meet the conditions, must retire to be entitled to the additional credit shall begin on
April 1, 1995 and end on July 1, 1995 and that to be entitled to the additional credit, eligible members,
who meet the conditions, must be employed in the Maintenance Department of the City of West
Covina on the date of adoption of this Resolution.

CERTIFICATION OF COMPLIANCE AND
TO MEET THE REQUIREMENTS OF SECTION 20821.6
The City of West Covina, in offering an additional two years of
service credit pursuant to Government Code Section 20821.6, does
hereby certify that:
1. All costs incurred as a result of the election of this
benefit shall be offset by salary and benefit savings;
and
2. The City of West Covina shall leave sufficient numbers
of positions vacant until an amount equal to or
exceeding the cost of providing the benefit through
PERS is satisfied; and
3. The City of West Covina shall transmit to the
retirement fund an amount determined by PERS equal to
the actuarial difference between the retirement
allowance a member receives through election of this
benefit and the amount they would have received without
the additional credit plus all applicable
administrative costs; and
4. The City of West Covina shall maintain records for each
employee retired pursuant to Section 20821.6; and
5. The City of West Covina shall provide verification of
its certifications through independent review should
the Board require; and
6. Eligible employees will not receive unemployment
insurance payments within two years of adoption of the
Resolution granting the benefit if employed by any
employer participating in the PERS retirement program;
and
7. The City of West Covina shall certify to PERS when the
amount of salary and benefit savings adequate to offset
the cost of funding the retirement benefits has been
achieved.
