Resolution - 9189RESOLUTION NO. 9189 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT FOR THE CORTEZ PARK FIELD LIGHTING PROJECT PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 1970, AS AMENDED. NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT CORTEZ PARK MASTER PLAN AMENDMENT NO. 7 APPLICANT: City of West Covina LOCATION: Cortez Park 2445 East Cortez Street WHEREAS, the City Council, on June 18, 1977, adopted the Cortez Community Park Specific Plan; and WHEREAS, the City of West Covina initiated a request for approval of a Master Plan Amendment to permit the installation of lighting for the existing football field and baseball field; and WHEREAS, the proposed project is considered a "project' pursuant to the terms of the California Environmental Quality Act (CEQA); and WHEREAS, an initial study was prepared for said project; and WHEREAS, based upon the findings of the initial study, it was determined that the proposed project will not have a significant impact on the environment and will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code; and WHEREAS, a Negative Declaration of Environmental Impact was prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended, and mitigation measures are included in said Negative Declaration in support of the finding that there was not a significant effect on the environment caused by this project. WHEREAS, the Planning Commission, upon giving the required notice, did on the 28th day of February, 1995, conduct a duly advertised public hearing as prescribed by law to consider said request; and WHEREAS, the Planning Commission, adopted Resolution No. 2-95-4278 at said public hearing recommending that the City Council certify the Negative Declaration of Environmental Impact; and WHEREAS, the City Council, upon giving the required notice, did on the 21st day of March, 1995, conduct a duly advertised public hearing as prescribed by law to consider said environmental documents. • NOW THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: 1. After receiving and considering all determinations, studies, documents, and recommendations, as well as other appropriate public comments, the City Council of the City of West Covina hereby certifies the Negative Declaration of Environmental Impact subject to compliance with the mitigation measures that are 95-0398/C:CC/CORT7RES. Air Normal wetting procedures or other palliative measures shall be followed during construction activities to reduce fugitive dust emissions in order to meet AQMD Rule 403 requirements. All construction activity shall b. Noise comply with Chapter 15 (Noise Ordinance) of the West Covina Municipal Code and Chapters 29 and 70 of the Uniform Building Code. Any amplified public address system used on the field shall be turned -off at 8:00 p.m. Such speakers used for a public address system shall be oriented away from adjacent residences. Signs shall be posted to prohibit the use of noise making devices (horns, drums, etc.) after 8:00 p.m. Annual assessments shall be conducted prior to executing the Facility Use Agreement in order to determine other additional measures which will eliminate noise impacts to adjacent properties. The assessment shall consider the league's compliance with the conditions of approval, complaints received, changes in league operations, etc. c. Plant Life Prior to commencing use of the light.system, it shall be determined if new planting is • necessary to minimize the potential effects of light and glare onto adjacent residential properties. Non-compliance with any of the aforementioned mitigation measures as . determined by the monitoring department/agency and any measures taken to correct said non-compliance shall be immediately reported to the Planning Department on the City of West Covina Mitigation Monitoring Checklist Form (Attachment 1). 3.
