Resolution - 9176CITY COUNCIL RESOLUTION NO. 9176 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST . COVINA, CALIFORNIA, APPROVING ORANGEWOOD PARK MASTER PLAN AMENDMENT NO. 1. ORANGEWOOD PARK MASTER PLAN, AMENDMENT NO. 1 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: City of West Covina LOCATION: Orangewood Park 1615 West Merced Avenue WHEREAS, the City Council initiated a request for the development of new roller hockey rinks on that certain property described as: Orangewood Park (1615 West Merced Avenue) Assessor's Parcel Map No. 8468-017-903 as shown in the records of the County Assessor, City of West Covina, County of Los Angeles, California; and WHEREAS, the Human Services Commission, upon giving the required notice, did on the 8th day of November, 1994, conduct a duly advertised public hearing as described by law to consider the said request and voted to recommend approval to the City Council; and WHEREAS, the Planning Commission, upon giving the required notice, did on the 1 oth day of January, 1995, conduct a duly advertised public hearing as described by law to consider the said request; and WHEREAS, the Planning Commission adopted Resolution No. 1-95-4271 recommending that the City Council approve Orangewood Park Master Plan Amendment No. 1; and WHEREAS, studies and investigations made by the City Council and in its behalf reveal the following facts: 1. The existing park site is in need of an upgrade of facilities. 2. The Environmental Quality Element of the West Covina General Plan, adopted in 1979, requires a master plan of design for all parks in the City of West Covina. 3. The existing park site is adequate in size and design for a neighborhood park, which is intended to serve residents within a one-half mile radius. _• 4. The proposed park master plan helps in the implementation of the goal of the West Covina General Plan to "provide adequate recreational facilities and programs for the citizens of West Covina." 5. An initial study prepared for the subject project has disclosed that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because mitigation measures have been incorporated into the project's design and as conditions of approval. A Negative Declaration of Environmental Impact has been prepared for the proposed project 1 JAY/OP7 CCRS.DOC/JAY26 West Covina Resolution No. 9176 Orangewood Park Master Plan Amendment No. 1 February 7, 1995 - Pane 2 pursuant to the requirements of the California Environmental Quality Act of 1970, as amended. . NOW THEREFORE, the Planning Commission of the City of West Covina does hereby resolve as follows: SECTION NO.1 Based on the evidence presented, the City Council hereby approves Orangewood Park Master Plan Amendment No. 1, subject to the following conditions: 1. Comply with Study Plan "A", dated January 1995 2. As allowed by Section 16-23 of the WCMC, commercial sales at the park site shall be permitted within a pro shop as indicated on the study plan. However, the operation of the pro shop at the site shall only occur in conjunction with the operation of the hockey rink or as otherwise provided in the operator's agreement with the City. 3. The applicant shall meet any and all monitoring or reporting requirements necessary to ensure compliance with the mitigation measures contained in the Negative Declaration of Environmental Impact as those may be determined by the City, including but not limited to entering into an agreement to perform and/for monitoring and reporting during project construction and implementation. The applicant further agrees he/she will cease construction of the project immediately upon written notice upon a violation of such requirements and that such a provision may be part of any agreement of the City and applicant. 4. Comply with the mitigation measures as outlined in the Initial Study/Environmental Assessment, prepared on December 21, 1994, as follows: a) All grading shall comply with Chapter 9 of the West Covina Municipal Code and Chapter 29 and 70 of the Uniform Building Code. b) Normal wetting procedures or other dust palliative measures shall be followed during demolition and excavation activities to reduce fugitive dust emissions in order to meet AQMD Rule 403 requirements. c) Grading and construction activity shall comply with the City's grading and noise ordinances. Requirements include, but are not limited to, restricting excavation, grading, and other construction activities to the hours between 7:00 a.m. to 8:00 p.m. Also, all construction equipment, stationary or mobile, shall be required to have properly operating and maintained mufflers. d) Comply with Chapter 15 of the West Covina Municipal Code regarding noise nuisances. The site shall be monitored for adverse noise impacts. Should adverse noise impacts occur at the site, the hours of operation and/or other aspects of the park operation shall be modified to mitigate the noise • impacts e) Lighting at the site shall be directed away from adjacent properties. f) Adequate parking for the roller hockey activities and other activities at the park site shall be provided on -site and/or off -site.
