Resolution - 9175CITY COUNCIL RESOLUTION NO. 9175 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION OF . ENVIRONMENTAL IMPACT FOR ORANGEWOOD MASTER PLAN AMENDMENT NO. 1, PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 1970, AS AMENDED. ORANGEWOOD PARK MASTER PLAN AMENDMENT NO. 1 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: City of West Covina LOCATION: Orangewood Park; 1615 West Merced Avenue WHEREAS, the City Council initiated a request for the development of new roller hockey rinks on that certain property described as: Orangewood Park (1615 West Merced Avenue) Assessors Parcel Map No. 8468-017-903 as shown in the records of the County Assessor, City of West Covina, County of Los Angeles, California; and WHEREAS, the proposed project is considered a "project' pursuant to the terms of the California Environmental Quality Act (CEQA); and WHEREAS, an initial study was prepared for said project; and WHEREAS, based upon the findings of an initial study, it was determined that the proposed project will not have a significant impact on the environment and will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code; and WHEREAS, a Negative Declaration of Environmental Impact was prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended, and mitigation measures are included in said Negative Declaration in support of the finding that there will not be a significant effect on the environment as a result of this project. WHEREAS, the Human Services Commission, upon giving the required notice, did on the 8th day of November, 1994, conduct a duly advertised public hearing as described by law to consider the said request and voted to recommend approval to the City Council; and WHEREAS, the Planning Commission, upon giving the required notice, did on the 10th day of January, 1995, conduct a duly advertised public hearing as described by law to • consider the said request; and WHEREAS, the Planning Commission adopted Resolution No. 1-95-4270 at said public hearing recommending that the City Council certify the subject Negative Declaration of Environmental Impact; and 1 JAY/OP1 CCNDR.D0C/JAY26 a • West Covina Resolution No. 9/7y Orangewood Park Master Plan Amendment No. 1 February 7. 1995 - Paae 2 NOW THEREFORE, the Planning Commission of the City of West Covina does hereby resolve as follows: 1. After receiving and considering all determinations, studies, documents, and recommendations, as well as other appropriate public comments, the Planning Commission of the City of West Covina does hereby recommend that the City Council certify the Negative Declaration of Environmental Impact subject to compliance with the mitigation measures that are recommended in the Negative Declaration of Environmental Impact as outlined below: ENVIRONMENTAL MITIGATION MEASURES MONITORING MONITORING IMPACTS DEPT/AGENCY METHODS a. Pre -construction Requirements include, but plan check. are not limited to, restricting excavation, Citizen's input. grading, and other construction activities to the hours between 7:00 a.m. to 8:00 p.m. Also, all construction equipment, stationary or mobile, shall be required to have properly operating and maintained mufflers. d. Noise Comply with Chapter 15 Human Citizen's Input of the WCMC regarding Services/ Code noise nuisances. The site Enforcement/ shall be monitored for Police adverse noise impacts. Light and Glare Lighting at the site shall be directed away from adjacent properties Engineering/ Planning On -site inspection Citizen's Input f. Transportation/ Adequate parking for the Human Pre -construction Parking roller hockey activities Services/ plan check and other activities at the Engineering/ park site shall be provided Planning on -site and/or off -site. Agreements by respective property owners authorizing the use of off - site parking spaces shall be obtained prior to the start of construction. 2. Non-compliance with any of the aforementioned mitigation measures as determined by the monitoring departmentlagency and any measures taken to correct said non- compliance shall be immediately reported to the Planning Department on the City of West Covina Monitoring Checklist Form (Attachment 1); and 3. The applicant agrees to implement the aforementioned mitigation measures and monitoring or reporting requirements; and 4. Failure to comply with any aforementioned mitigation measures and/or monitoring or reporting requirements will result in a written notice of violation from the City to the applicant at which time the City may order that all or a portion of pre -construction, construction, post -construction activity or project implementation must cease until compliance is reached; and 5. The California Environmental Quality Act (CEQA) and State and local guidelines, rules, regulations and procedures adopted pursuant thereto permits the City of West Covina to impose any fees or charges associated with implementing the above monitoring program upon the applicant; and 6. The City Council, upon giving the required notice, did on the 7th day of February, 1995 conduct a duly advertised public hearing as prescribed by law to consider said application and environmental documents; and 7. The City Clerk shall certify to the passage of this Resolution. PASSED AND APPROVED on this 7th day of February, 1995.
