A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AUTHORIZING THE
DESTRUCTION OF RECORDED RADIO AND TELEPIIONE
• COMMUNICATIONS AS PRESCRIBED BY LAW.
WHEREAS, Section 34090.6 of the Government Code states that the head of a city
Public Safety Communications Center may destroy, after 100 days, recordings of telephone and
radio communications routinely maintained by the department provided such destruction is
approved by the legislative body and consented to by the agency's attorney; and
WHEREAS, the city's Public Safety Communications Center does tape record on a 24
hour basis, all telephone and radio communications emanating to and from the center; and
WHEREAS, it is the Communications Department's policy to retain all such tapes for
a minimum of 182 days before they are erased and reused; and
WHEREAS, tapes are automatically saved beyond the 182 day period whenever any of
the following circumstances exist:
• Whenever there is a fatality and our police, fire, or paramedic personnel are involved;
• Whenever there is an officer involved shooting;
• Whenever there is a major fire resulting in substantial loss of property;
• Whenever so requested by police, fire, or other staff representative, in connection with
a known or suspected claim filed against the city; and
WHEREAS, due to the need to erase and reuse such tapes on a daily basis, it would be
impractical for the City Council and City Attorney to specifically approve the destruction (i.e.
erasure) of each and every tape; and
WHEREAS, the City Attorney, by acknowledgement as shown on Exhibit A hereto, has
consented to the erasure of tapes in accordance with the policies outlined above.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA
DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. That the tapes of recorded radio and telephone communications emanating
to and from the city's Public Safety Communications Center may be destroyed (i.e. erased and
reused) in accordance with the policies outlined above.

SECTION 2. The City Clerk shall certify to the adoption of this Resolution.

I hereby consent to the routine destruction (i.e. erasure and reuse) of the recorded
radio and telephone communications within the City's Public Safety
Communications Center, provided the tape retention policies outlined above are
maintained.
