A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, ESTABLISHING ADULT ORIENTED BUSINESS
PERMIT APPLICATION FEES.
• WHEREAS, on September 14, 1993, the Planning Commission adopted
Resolution No. 9-93-4186 initiating and directing staff to prepare a code amendment
to establish regulations for adult oriented businesses and publication vending
machines (Amendment 257);

WHEREAS, the Planning Commission upon giving the required notice did on the
22nd day of March, 1994, conduct a duly advertised public hearing as prescribed by
law to consider Amendment No. 257; and
WHEREAS, upon considering studies and investigations at said public hearing,
the Planning Commission adopted Resolution No. 03-94-4220 recommending that the
City Council adopt Amendment No. 257; and
WHEREAS, Amendment No. 257 includes provisions to establish a permit
process for the review of adult oriented business which desire to locate in the City of
West Covina; and
WHEREAS, the City Council desires and finds it necessary to establish a fee for
the service of processing adult oriented business permit applications; and
WHEREAS, based upon the existing fee structure to process similar
applications, the City Council finds that the fees included in this resolution will
reasonably recover the estimated costs incurred by the City; and
WHEREAS, the City Council upon giving the required notice did on May 3,
1994, conducted a properly advertised public hearing to consider adoption of this
resolution pursuant to Government Code Sections 66016 and 66018.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of West
Covina does hereby resolve as follows:
SECTION NO. 1: The following fee is hereby established by the City Council
to be collected at the time an application for an Adult Oriented Business Permit is
submitted to the Planning Department: $750 deposit, including a $75 filing fee,
against which the hourly staff fee of $55 per hour will be charged.
SECTION NO. 2: Pursuant to Government Code Section 66017, this
resolution shall become effective no sooner than 60 days following its adoption.
SECTION NO. 3: The City Clerk shall certify to the adoption of this resolution
and shall cause the same to be published as required by law.
ADOPTED AND APPROVED this 3rd day of May, 1994.
