A:k4'[ RESOLUTION NO. 8987 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING THE TRANSMITTAL OF THE 1993 CMP CONFORMANCE CHECKLIST TO THE LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY (LACMTA), SERVING AS EVIDENCE THAT THE CITY OF WEST COVINA IS IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP). WHEREAS, the Legislature of the State of California has found that the lack of an integrated transportation system and the increase in the number of vehicles are causing traffic congestion that each day results in hundreds of thousands of hours lost in traffic, tons of pollutants released into the air, and millions of dollars of added costs to the motoring public; and WHEREAS, the Legislature has adopted legislation requiring the preparation and implementation of a Congestion Management Program ("CMP") by county transportation commissions or other public agencies of every county that includes an urbanized area; and WHEREAS, the Metropolitan Transportation Authority ("MTA") is responsible for the preparation of the CMP for the Los Angeles County; and WHEREAS, in November of 1992, the Metropolitan Transportation Authority (MTA) adopted the first Congestion Management Plan (CMP) for Los Angeles County and certified the accompanying Final Environmental Impact Report (EIR); and WHEREAS, local jurisdictions have significant CMP implementation responsibilities which include assisting in monitoring the CMP roadway system; adopting and implementing a trip reduction and travel demand ordinance; and analyzing the impacts of local land use decisions on the CMP regional transportation system; and WHEREAS, the MTA will annually review the performance of local jurisdictions to verify that they are conforming to CMP requirements; and WHEREAS, in order to receive their portion of the state gas tax increase enacted with the passage of Proposition 111 in June 1990, a local jurisdiction must comply with local CMP requirements established in Section 65088 through 65089.2 of the California Government Code; and WHEREAS, the MTA has established a conformance procedure, whereby local jurisdictions will annually self -certify that they are in conformance with the major local CMP responsibilities with the completion of a CMP Conformance Checklist; and WHEREAS, the CMP Conformance Checklist must be approved at a public hearing by the local jurisdiction's governing body and transmitted to MTA by August 1, 1993; and WHEREAS, the City Council, upon giving the required notice, did on the 6th day ® of July, 1993, conduct a fully advertised public hearing. WHEREAS, the oral and documentary evidence considered in connection with the 1993 CMP Conformance Checklist submittal reveal the following facts: 1. By June 15, 1993, the City of West Covina has conducted annual traffic counts and calculated levels of service for selected arterial intersections, 0454-93/C:CC/CMP93RES/em • Resolution No. 8987 CMP/CONFORMANCE/CHK/LIST July 6. 1993 Page 2 as specified in the traffic monitoring procedures found in the CMP Highway and Roadway System Chapter. 2. The City of West Covina has adopted and implemented a transportation demand management ordinance. The TDM ordinance is consistent with the minimum standards identified in the CMP's TDM Element, was adopted by the City Council of West Covina on February 16, 1993, and submitted to the LACMTA upon adoption. 3. The City of West Covina has adopted and implemented a land use program to analyze the impacts of new development on the CMP system and the associated mitigation costs. The program is consistent with the standards identified in the CMP's Land Use Analysis Program Chapter. This program was adopted by the City Council of West Covina on February 16, 1993, and submitted to the LACMTA upon adoption. NOW, THEREFORE, the City Council of the City of West Covina does hereby resolve as follows: SECTION NO. 1.: After receiving and considering all determinations, studies, documents, and recommendations, as well as other appropriate public and agency comments, the City Council of the City of West Covina hereby approves the transmittal of the 1993 CMP Conformance Checklist to the Los Angeles County Metropolitan Transportation Authority. SECTION NO. 2.: It has been determined that this project, which serves as evidence that the City of West Covina is in conformance with the Los Angeles County Congestion Management Program ("CMP"), is categorically exempt pursuant to Section 15321 (Class 21) of the State CEQA Guidelines and no Environmental Impact Report or Negative Declaration of Environmental Impact is required. SECTION NO. 3.: The City Clerk shall certify to the passage of this resolution. ADOPTED AND APPROVED this 6th day of July, 1993.
