A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, VACATING AND ABANDONING A CERTAIN
EASEMENT WHICH HAS BEEN SUPERSEDED BY RELOCATION.
(Centermark Properties of West Covina, Inc.)
WHEREAS, Centermark Properties of West Covina, Inc. has requested the
vacation of a portion of a certain easement; and
WHEREAS, the expansion of the Plaza at West Covina requires the removal
of this easement; and
WHEREAS, the non-use renders the easement no longer needed for public
utility facilities purposes.
NOW, THEREFORE, the City Council of the City of West Covina does
resolve as follows:
SECTION 1. Pursuant to Sections 8330 to 8336, inclusive, of the Streets and
Highways Code, the City Council of the City of West Covina hereby finds and
determines that the following described easement has been superseded by relocation:
THAT CERTAIN EASEMENT FOR PUBLIC UTILITY FACILITIES,
RECORDED ON OCTOBER 27, 1972, AS INSTRUMENT NO. 4468, IN
BOOK D-5442, PAGE 394 OF OFFICIAL RECORDS.
SECTION 2.The easements described in Section 1 are hereby summarily
vacated and abandoned.
SECTION 3.The City Clerk shall certify to the adoption of this resolution and
shall cause a certified copy thereof to be recorded in the Office of the County
Recorder of said County.
