Resolution - 8815R E S O L U T I O N N O. 8815. I • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT PREPARED FOR AMENDMENT NO. 248. WHEREAS, on September 18, 1991, the Planning Commission adopted Resolution No. 9-91-3990, initiating an amendment to the zoning code as it relates to establishing provisions and development standards for materials recovery facilities ("MRFs") and solid waste transfer and processing stations ("transfer stations") (Amendment No. 248); and, WHEREAS, the Amendment No. 248 is considered a project pursuant to the California Environmental Quality Act of 1970, as amended; and WHEREAS, an initial study was prepared for said project; and WHEREAS, based upon the initial study, it was determined that the project, in and of itself, could not result in any potential adverse significant environmental impacts and a Negative Declaration of Environmental Impact was prepared; and, WHEREAS, a Negative Declaration of Environmental Impact was prepared for the proposed project pursuant to the requirements of CEQA, 1970, as amended. WHEREAS, the Planning Commission, upon giving the required notice, did on the 13th day of January, 1992, the 17th day of March, and the 13th day of April, 1992, conduct a duly advertised public hearing as prescribed by law to consider said initial study; and, WHEREAS, after considering the proposed project and Negative Declaration of Environmental Impact, the Planning Commission of the City of West Covina recommended that the City Council certify the Negative Declaration of Environmental Impact. NOW, THEREFORE, the City Council of the City of West Covina does resolve as follows: SECTION NO. 1.: After, receiving and considering all determinations, studies, documents, and recommendations, as well as other appropriate public and agency comments, the Planning Commission of the City of West Covina hereby recommends to the City Council of the City of West Covina certification of the Negative Declaration of Environmental Impact. SECTION NO. 2: The City Council does hereby find that the proposed project -will not have an adverse impact upon fish or wildlife resources. SECTION NO. 3: The City Council does hereby find that the Negative Declaration of Environmental Impact has .been independently and thoroughly reviewed by staff, and represents the independent judgement of the City. SECTION NO. 4: The City Clerk shall certify to the passage of this resolution.
