RESOLUTION NO. 8807
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA CREATING A WASTE MANAGEMENT
ENFORCEMENT AGENCY, DESIGNATING A LOCAL
ENFORCEMENT AGENCY AND HEARING PANEL FOR
ENFORCEMENT OF A SOLID WASTE MANAGEMENT
PROGRAM IN THE CITY OF WEST COVINA, AND
APPOINTING A LOCAL ENFORCEMENT AGENCY PROGRAM
MANAGER

WHEREAS, the City Council does hereby find, determine and
declare that California Public Resources Code section 43203(c)
authorizes the City Council to designate a separate Local
Enforcement Agency ("LEA") for the City of West Covina.
NOW,'THEREFORE, the City Council of the City of West Covina
does resolve as follows:
SECTION 1. The City Council does hereby create the City of
West Covina Waste Management Enforcement Agency ("WMEA") and,
pursuant to California Public Resources Code section 43203(c), does
hereby designate the WMEA to be the LEA for the City of West
Covina.
SECTION 2. The City Council does hereby create the
position of Waste Management Enforcement Manager ("WME Manager") to
oversee the WMEA, and appoints the WME Manager as the LEA Program
Manager.
SECTION 3. The City Council, does hereby designate itself
to be the hearing panel, pursuant to Public Resources Code section
44800(a) and Title 14, California Code of Regulations section
18060. As such, the City Council shall conduct all hearings
required by Public Resources Code Part 4, Chapter 4, and Part 5,
Chapter 1.
SECTION 4. The designations and appointments provided for
in this resolution shall be effective upon certification of the
City's LEA program by the California Integrated Waste Management
Board, and shall continue unconditionally until such designations
and appointments are revoked or modified by formal resolution of
the City Council.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
